ZÁVĚR Mezinárodní příslušnost soudů je v dnešní sjednocené Evropě velmi významným institutem mezinárodního civilního procesního práva. S přistoupením velkého množství států do EU v posledních několika letech a s dalším jejím očekávaným rozšířením se tak postupně zvětšuje území, na kterém se Nařízení Brusel I uplatňuje. Pro soudy a subjekty členských států, které byly smluvními stranami Bruselské úmluvy, nejsou pravidla určování soudní příslušnosti dle Nařízení Brusel I žádnou novinkou, subjekty a soudy nových členských států se však musely a budou muset pro ně novému "Bruselskému modelu" určování příslušnosti přizpůsobit. Z výše uvedeného důvodu bylo jedním z cílů této práce vymezit jednotlivá pravidla soudní příslušnosti dle Nařízení Brusel I, jejich vzájemné vztahy a systém tak, aby bylo žalovanému i žalobci předem známé, který soud by mohl být příslušný projednávat jejich budoucí či již existující spor. Na základě rozboru jednotlivých pravidel jsem dospěla k následujícímu závěru. Základní pravidlo příslušnosti soudů dle bydliště žalovaného může žalobce uplatnit až na výjimky vždy, a to bez ohledu na předmět konkrétního sporu. Alternativní pravidla příslušnosti I a II, která umožňují žalobci žalovat žalovaného u soudu jiného státu než státu jeho bydliště, představují alternativu k základnímu pravidlu a... RESUMÉ (SUMMARY) International civil procedural law in EU - selected issues focusing on jurisdiction according to the Council Regulation (EC) No 44/2001, Brussels I This thesis deals with the jurisdiction according to the Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, so-called Brussels I Regulation. The reason why I have chosen this topic is that in my opinion the knowledge in this subject is at the present time very important for the practice of every lawyer in the European Union, because the rules of the Brussels I Regulation regulating which courts have jurisdiction in legal disputes of a civil or commercial nature between individuals resident in different member states of the European Union are valid and directly applicable in all Member States. The main purpose of this thesis is to determine particular rules of jurisdiction and their interrelations and to describe in detail the rules of special jurisdiction according to articles 5,6 and 7 of the Brussels I Regulation, above all on the strength of the judicature of the European Court of Justice.
