Politicising EU Leadership Selection: Explaining the Success and Failure of the Spitzenkandidaten Procedure from the perspective of Postfunctionalism

EN With the changes in the Lisbon treaty, the party groups of the European Parliament unilaterally introduced the Spitzenkandidaten procedure, nominating lead candidates for the office of the President of the European Commission for the European elections of 2014. After its arguable success in 2014, when Jean-Claude Juncker became President of the Commission, the procedure then failed in 2019, when the national leaders in the European Council selected Ursula von der Leyen as Commission President. She had not stood as a lead candidate of her party family during the election. Considering the circumstances, the following question presents itself: Why did the Spitzenkandidaten procedure seemingly fail in 2019, when it was already successful in 2014? This thesis attempts to answer this question by formulating an argument on the basis of Postfunctionalism that domestic politicisation of the topic lead to constraining dissensus at the EU level, which resulted in the rejection of the Spitzenkandidaten procedure. Role of the European Council in the pre-legislative stage of the EU legislative process

The aim of the master thesis "The role of the European Council in the pre-legislative phase of the European legislative process" is to analyse position and influence of the European Council before proposing an official legislative proposal by the European Commission in the EU's legislative process. This pre-legislative phase of a designing of a European legislation is important, though informal. The aim of this master thesis it to find out how strong is the European Council in an agenda setting when it comes to a European legislation and to what extent the Commission is inspired or follows the European Council's conclusions when proposing a legislation. According to many authors who this thesis referring to and their research that this thesis follows, an importance and influence of the European Council has been growing a lot, recently. In their view, it has been happening primarily during serious political or economic crisis. The Commission's position as the only official proposer of a European legislation weakens in that moments while influence of the EU summits grows. Brexit and mutual trade between the Czech Republic and the United Kingdom

This bachelor thesis deals with the current issue of leaving the United Kingdom of Great Britain and Northern Ireland from the European Union, assesses the possible impact of Brexit on mutual trade between the Czech Republic and the United Kingdom and evaluates its possible impact on the Czech economy. After a brief overview of the history of the UK membership in the EU, a description of the complicated EU and UK negotiations follows. Another chapter deals with some studies and analyzes evaluating the impact of Brexit on the British economy. The following discussion concerns negotiated Withdrawal Agreement and some possible EU-UK mutual relation models after finishing the transition period - membership in the European Economic Area (Norwegian model), negotiation of a free trade agreement (Swiss model, Canadian model), withdrawal without agreement (hard Brexit). The UK is one of the most important export partners of the Czech Republic, which results from the evaluation of mutual trade exchange data. In the final part, this thesis examines the possible influence of the decline of the British economy consumption on GDP of the Czech Republic using the Input- Output analysis and evaluates the potential impact of Brexit on the mutual trade between the Czech Republic and the UK in the automotive industry....

The first part focuses on the history of the European Parliament and the ratification of the Lisbon Treaty. The second part follows the first and compares concrete changes EP after Lisbon Treaty. This part also summarizes the most important changes in the EU after the Lisbon Treaty.

The phenomenon of Spitzenkandidaten and its impact on the interinstitutional dynamics of the EU

The bachelor thesis describes the process of the enforcement of the Spitzenkandidaten procedure into the EU political system. An ambiguous definition of the relation between the Commission Presidential Candidacy and European election results, which emerged in the Lisbon treaty, led to the creation of a new political precedent that has real chances to remain for good among the EU procedures. This thesis will nevertheless show that suggestions that the victorious party should name its candidate for the Commission President are not new. Moreover, it will highlight that the process of the EP and the Commission getting ever closer is a result of a much longer process. The arguments for and against the new procedure will be presented and evaluated. A detailed insight into the European elections 2014 campaign, which had a partially different shape due to the Spitzenkandidaten process, will provide the reader with an answer to which extent the outcomes of the elections were actually influenced by this exact procedure. The same objective is borne in mind when the candidacy of Jean-Claude Juncker is evaluated, proving him to be, although elected not traditionally, a candidate-as-usual. EU linguistic regime in practise: comparison of availability of documents in Czech, French and English on the website of the European Council

This bachelor thesis consists of the theoretical and the practical part and deals with the language regime of the European Union in practice. In the theoretical part will be briefly introduced to the institutional framework of the Europen Union and the location of the European Council in it. In this part will be also described the language regime of the European Union and of the European Council. In the practical part will be firstly described the structure of the website of the European Council. After it will be analyzed the availability of documents in Czech, in French and in English on the website of the European Council. In conclusion, the obtained results will be evaluated both quantitatively and qualitatively.

Efektivní koordinace národních pozic: základ úspěchu ČR v EU

Efektivní koordinace pozic České republiky na národní úrovni je základním předpokladem pro úspěšné hájení jak dlouhodo- bých, tak krátkodobých národních zájmů. Evropské záležitosti již nepředstavují zahraničně-politickou agendu, ale agendu vnitřní – záběr politik EU je natolik široký, že rozhodování na úrovni EU je třeba vnímat jako evropské patro domácí politiky. Lisabonská smlouva dále rozšířila počet oblastí, ve kterých se rozhoduje kvalifikovanou většinou. O to větší tlak vzniká na připravenost jednotlivých členských států během vyjednáva- cí fáze legislativního procesu a nutnost pro zástupce jednot- livých resortů hovořit na půdě EU jedním hlasem. Základem úspěšného vyjednávání na evropské půdě je mnohem více než doposud soulad pozic zainteresovaných resortů, jejich účinné propojení při vyjednávání horizontálních záležitostí zasahu- jících do agendy více ministerstev, ale také sdílená „institu- cionální paměť“ a ucelený přehled o vývoji agend EU a jejich vzájemných souvislostech: jednotlivé politiky EU jsou stále více propojeny a žádají si proto přístup napříč resorty, s nut- ností stanovovat horizontální priority na úrovni státu, nikoli izolovaně na úrovni jednotlivých ministerstev. Lisabonská smlouva zároveň oddělila projednávání všeobec- ných záležitostí v rámci Rady EU od záležitostí zahraničních. Tato změna by pro větší efektivitu prosazování národních po- zic měla mít za důsledek i vnitrostátní oddělení agendy. Ko- ordinace národních pozic by proto měla být svěřena úřadu funkčně i materiálně oddělenému od stávajících ministerstev, zejména pak od ministerstva zahraničních věcí. Cílem tohoto policy paperu je navrhnout konkrétní změny v současném institucionálním nastavení koordinace pozic České republiky v rámci EU, zejména v kontextu EU fungující podle Lisabonské smlouvy. Hlavním návrhem je výrazné posílení role samostatného od- boru pro evropské záležitosti podléhajícího vicepremiérovi pro evropské záležitosti (varianta I), či přímo předsedovi vlá- dy (varianta II). Úřad pro evropské záležitosti, jenž by měl for- mu samostatného ministerstva (varianta I) nebo sekretariátu pro evropské záležitosti (varianta II) musí mít trvale zajištěnu finanční i personální autonomii jak na stávajících resortech, tak na úřadu vlády. Musí být rovněž nezávislý na politické konjunktuře. Druhá sada návrhů se týká zkvalitnění práce Parlamentu Čes- ké republiky, především pak Poslanecké sněmovny, a většího zapojení zákonodárců do projednávání legislativy na úrovni EU. Klíčové je v tomto ohledu zejména posílení role Výboru pro evropské záležitosti, jehož členy by měly být ex officio místopředsedové výborů PSP relevantních z hlediska kompe- tencí EU.

Amendments to the EU Treaties - the establishment of the European Stability Mechanism: Study 3.097

Smlouva o Evropské unii ve znění Lisabonské smlouvy (dále jako SEU), jež vstoupila v platnost dne 1. prosince 2009, v čl. 48 odst. 6 nově upravuje možnost zjednodušeného přijímání změn části třetí Smlouvy o fungování Evropské unie ve znění Lisabonské smlouvy (dále jako SFEU). V současné době je na evropské úrovni projednáván první návrh změny SFEU, jenž má být uskutečněn prostřednictvím zjednodušeného postupu. Impulsem k této změně byla snaha o zajištění finanční stability členských států Evropské unie, které jsou zároveň součástí eurozóny (Evropský mechanismus stability). Studie v první části přináší výklad vnitrostátní procedury schvalování zjednodušené změny Smlouvy a ve druhé části popisuje samotný mechanismus stability, který má být touto procedurou zaveden.

The Czech EU Council Presidency – priorities in justice and home affairs issues

This work is devided into 5 main parts. The first two parts, about the European union and the Czech EU Council Presidency, cover the main information about the European union functioning and Council Presidency system and includes both, concrete information about the Czecch Council Presidency and key information, which are necessary to understand following parts of that work. The second part of the work deal with the priorities in justice and home affairs issues within the European union and monitor their progress in the last years, but mainly during the Czech Council Presidency in 2009.
