NÁZEV DIPLOMOVÉ PRÁCE V ANGLICKÉM JAZYCE The Criminalization of Cyberattacks on Information Systems ABSTRACT This master thesis deals with the issue of criminalization of attacks on information systems. The topicality of the topic is supported by the rapid development of information and communication technologies and the shift of everyday activities to the virtual environment. Nowadays, cybercrime poses a growing danger not only to individuals but also to the state. The aim of this thesis is to introduce cyberattacks and to classify them criminally. Furthermore, attention is concentrated on the procedural aspect of attacks, in particular on their detection, investigation and the procedure of international cooperation. The transnational and international framework in the fight against cybercrime is not omitted. The thesis seeks to identify what problematic aspects domestic legislation faces and what future developments in the field of cybercrime can be expected. The introductory section explains the basic terms that are used extensively in the thesis. Subsequently, key international instruments in the fight against cybercrime are introduced. Legal framework of computer crime investigation

Master's thesis is focused on computer crime, with an emphasis on the process of investigation. New systematics in Czech computer crime terminology is offered. Within the thesis, cybercrime is perceived as a part of computer crime. Special attention is put on various aspects of criminalistics, as the topic of investigation itself is understood from the point of view of such science. Nevertheless, criminological findings are discussed likewise. Particular emphasis is put on a link between Czech legal regulation and expert literature from the fields of law, criminalistics, criminology and technology. Master's thesis is based on Czech literature, as well as English and French writings, in addition to national and international case law. The text itself is divided into three chapters. First chapter is introducing the issue of computer and cybercrime with selected criminological characteristics, including specifics of offending within the Internet. Second chapter discusses evidence of computer crime, the electronic or digital evidence, from the point of view of criminalistics. ABSTRACT, KEY WORDS Seizing digital tracks for the purpose of a criminal proceeding This thesis analyzes procedural institutes of law that serve to seize digital traces on the Internet to investigate cybercrime. This document also deals with a selected procedural institute of the Convention on Cybercrime, which serves to secure digital traces. Furthermore, an assessment is made as to whether the Czech legislation meets these requirements. Data retention analysis provided information on what traffic and location data are and describes the extent of their retention. The issue of identification of offenders based on seized IP addresses was explained and anonymization methods were explained. The main goal of the thesis is an extensive elaboration of some relevant procedural institutes of the Code of criminal procedure no. 141/1961 Sb., through which digital traces are seized. This data may lead to the identification of the offender, and also for conviction of guilt during criminal proceedings. The thesis elaborates institutes: a record of telecommunication traffic, monitoring digital communication, data freeze, and physical provision of devices. Criminological and criminal law aspects of the ransomware spread

The subject of this diploma thesis is the ransomware spread, which is currently one of the most prominent global cybernetic threats. Ransomware is malicious code that, when activated on a computer system, usually blocks access to that system or encrypts the data contained in it, which is then used to blackmail the user. This thesis deals with criminological and criminal aspects of this phenomenon. In its criminological part, this thesis deals with the issue of the etiology of the ransomware spread and its criminogenic factors, while examining, among other things, the applicability of cybercriminological theory named space transition theory to a given phenomenon. It also deals with the victimological aspect of the matter, listing the most fundamental factors influencing victimization, both in the case of widespread non-targeted ransomware attacks and in the case of specifically targeted attacks. It also examines the issue of the high latency of this phenomenon and cybercrime in general and the possibility of prevention, which it considers to be the best way to defend against a ransomware attack. Today, the phenomenon of cybercrime can no longer be considered something obscured or unknown to the general public. Yet the majority of general population is aware of only a fraction of the offenses committed in cyberspace. As a result, a substantial proportion of Internet users act in violation of valid legislation in cyberspace, whether they do so knowingly or not. Cybercrime cannot be considered less dangerous than other forms of crime. On the contrary, due to its availability, globality and possible distance of the offender from the crime itself, this kind of criminal behaviour is on the rise year by year and its effects are becoming more severe, mainly due to the dependence of today's society on information and communication technologies. The aim of this thesis is to provide an introduction to the cybernetic world crime and offer a general view of the various aspects of this criminal activity. Legal provisions on cybercrime in the European Union Abstract This thesis deals with a complex phenomenon of cybercrime from the perspective of legal provisions of the European Union. Therefore, the thesis presents the fundamental features of cybercrime and presents the fundamental typology of this crime, which is supplemented by examples of the most common crimes. This general framework describing cybercrime is followed by an analysis of the legal provisions of the international law and Union law. Witihin the framework of the international legal provisions the thesis presents the activities of the universal organizations, in particular the Council of Europe, whose international convention on cybercrime is also subject to the analysis, and of the regional organizations.The legal regulation of cybercrime in the European Union is examined from the point of view of both primary and secondary law, outlining the fundamental orientation of the Union's policies concerning information technology. Following the clarification of the EU legal provisions on cybercirme, the thesis also presents the legal framework of such area within the Canadian law. Criminological aspects of cybercrime Abstract The thesis concerns the offenders and victims of cybercrime as the selected criminological aspects of cybercrime. The objective of the thesis was to particularly analyse and compare the criminological findings of the offenders and victims of cybercrime and discover and point out the specifics in comparison to the offenders and victims of the offline criminality. Both Czech and foreign literary sources were used for the purposes of this thesis. In the first part the basic terms which are used in this thesis are clarified - cybercrime, the offender and victim including the particularly vulnerable victims. The second part concerns the development of the image of the offender of cybercrime, his characteristics in comparison to the offenders of crimes committed out of cyberspace and his categorization. Particularly the attention was brought to the organized groups of criminals in the area of cybercrime and the motivation of the offender as one of the criminogenic factors. In the third part different victimological aspects of cybercrime including the impact of this kind of criminality on the particularly vulnerable victims are discussed. Cyber Crimes and it’s influential factors in Ghana

This bachelor thesis present results of the study of cybercrime and its influential factors in Ghana. Information Communication Technology (ICT) has undoubtedly been a tool for rapid globalization due to its efficient facilitation of businesses, education, legal systems and others. This has been achieved through the Internet as it has no geographical boundaries and thus made the world a global village. Nonetheless, the Internet has been a coin with two sides where besides offering positive and efficient legal life services, is being used by others to commit crime called cybercrime. This has posed great threat and challenges to individuals and institutions of developing countries like Ghana who is now integrating and embracing technology to enhance productivity and economic growth. This study therefore investigated the driving forces behind the rise of cybercrime cases and its projections in Ghana using Winneba as the study area. A sample size of 119 was selected by purposive sampling design to achieve the study’s objectives. The study employed both questionnaire and interview as the research instrument for primary data collection. Appropriate statistical procedures such as frequency distribution tables, graphs and Chi-square test were used to present and analyse the data. The result revealed the dominant possession of ICT gadgets especially smart phones that can access the Internet among the respondents. Also, individuals indulge in cybercrime mainly because of unemployment with poverty, laziness and the quick quest to become rich being its supplementary factors. Moreover, cybercriminals were more interested in service theft and money laundering compared to other cybercrimes. They usually use sophisticating tricks and transiently taking advantage of their hacking skills to defraud vulnerable people. However, ICT must still be integrated with minimal financial lost in Ghana and that there is the utmost need for robust protective mechanism.

Tato bakalářská práce se zabývá koncepcí kybernetické kriminality. Začíná popisem historického vývoje kybernetické kriminality a s ní související počítačové technologie. Práce dále uvádí důvody, proč ke kybernetické kriminalitě dochází, a popisuje kybernetickou kriminalitu z praktičtějšího hlediska, přičemž analyzuje různé typy útoků a útočníků včetně názorných příkladů. Teoretická část práce je zakončena kapitolou věnující se prevenci a detekci kybernetických hrozeb. Účelem praktické části je ukázka jednoduchého Denial of Service útoku.
