European legislation in tourism and gastronomy

The diploma thesis "European legislation in tourism and gastronomy" summarizes legislative changes related to the Czech Republic after joining the European Union. In the theoretical part is examined in detail the structure of the European Union - the EU Treaty, the EU Institutions and the executive, legislative and judicial power. The practical part describes the changes in legislation and their impact on the tourism and hospitality sector. The thesis assesses the pros and cons of the new legislation and the effect of how new directives and regulations affected the activities of the Czech operators of restaurants and hotels.

Parlament České republiky má podstatným způsobem ztíženu možnost změnit hranice Národního parku Šumava. Nemůže přijmout věcnou novelu nařízení vlády, kterým byl park zřízen. Z toho vyplývá, že po celá desetiletí je řádný zákonodárce v podstatě vyloučen z možnosti zmenšit nebo zvětšit území národního parku prostřednictvím vlastní zákonodárné iniciativy. Aby mohli být poslanci úspěšní, museli by navrhnout a přijmout celý nový zákon o Národním parku Šumava. Jiným méně razantním způsobem není možno do hranic parku zasáhnout. Je jistě náročné pro jednotlivé poslance vypracovat celý nový zákon, čímž je omezeno právo zákonodárné iniciativy poslanců a poslaneckých skupin. Rovněž další subjekty, které mají právo zákonodárné iniciativy, jsou tímto omezením zasaženi (včetně zastupitelstev krajů). Takto je petrifikován dosavadní právní stav, který sice z procesuálního hlediska není možno považovat (ve světle judikatury Ústavního soudu) za protiústavní, nicméně jeho dlouhodobé pokračování už je z hlediska práv jednotlivých subjektů zákonodárné iniciativy i z hlediska práv zákonodárce problematické. Rovněž některé další důvody, zejména aspekty týkající se právního státu, vedou k závěru, že se nařízení vlády, kterým byl zřízen Národní park Šumava, ocitá na samých hranicích konformity s Ústavou České republiky.

Report creation rules in GE Money Bank

Reporting in BusinessObjects in a large company especially in the bank must have some rules. The result of this thesis is a draft of codification of these rules for a particular environment. This draft will in practice be used to create an internal regulation, which will be mandatory in Department Operations. The proposed regulation contains comments and questions that need to be resolved before creating legislation. On this basis it will be possible to discuss the whole issue of report creation in this department. Output and purpose of this thesis are the impetus for legislation arising from the analysis of laws and internal regulations, and are supplemented by reporting requirements for the unification and best practices. These additional requirements will be for example in the form of naming conventions, commenting of objects, etc. The regulation will then be published as a supplement to the more general internal regulation. Regulation will be used for internal purposes when creating reports. The user who will act in accordance with this regulation will facilitate the work to develop a report in all phases and will use the best practices collected from various Internet resources, and the experience of other users and colleagues, whose contributions will be delivered during the discussion of individual points during the development of regulation. The resulting report will meet all statutory and other requirements.
European Economic Interest Grouping

The thesis contains a description and a legal analysis of the European Economic Interest Grouping. The goal is achieved through the method of description, analysis and comparison. The first chapters of the thesis are devoted to incorporation of the Grouping, development of legislation relating to the Grouping, applicable system of law and the topic of legal nature of the Goruping. The way of how to incorporate a Grouping is described in the following chapter. Furthermore, the rights and obligations deriving from the membership in a Grouping are explained. The final chapters are devoted to the process of dissolution of the Grouping and to popularity of the Grouping throughout the EU countries.

This bachelor thesis named Decentralised bodies of the European Union deals with the analysis of the European agencies. The thesis starts with the legal structure of the European Union and the division of its policy to three pillars and it outlines the operation of four principal institutions of the European Union. It describes the history of creation of the agencies, its legal basis and the frame of their activities. The thesis reveals the operation of the agencies within the frame of the European institutions and describes their competences and authorities. In the end, it investigates the existence of the agencies if they are profitable or unnecessary.
European Economic Interest Grouping

The theme of this bachelor thesis concerns European Economic Interest Grouping (EEIG). The theoretical part deals with main aspects of grouping which are legal regulations, termination and dissolution of a grouping. The practical part of this bachelor thesis demonstrates the confrontation of European Economic Interest Grouping with G.I.E. (Groupement d'intéret économique), which is comparable with Economic Interest Grouping in French business law. This grouping was a model for EEIG. Furthermore the thesis deals with statistics of EEIG in member states of European Union. The biggest attention is paid to EEIG in Czech Republic. In the conclusion the thesis is briefly summarized. Then the position of EEIG regarding other international forms of business in European Union is evaluated.
Community law of the Structural funds

This bachelor thesis focuses on an issue of the Structural funds according to a legislation of the European Union. This issue is significant for a progress of economy of Member States and thus all the Community. The Member States have a possibility to obtain public contributions for their preferred areas. The first part of the thesis is dedicated to a definition and main characteristics of the Community law. The following part offers a summary of a content of regulations, concerning the Structural funds, which are implemented in the Member States with a direct effect. The aim of the last chapter is to demostrate an interpretation of chosen Czech operational programmes and their conformity or diversity with the law.
