Implementatiton of international human rights standards in the field of human trafficking for labour exploitation in the Czech Republic

Trafficking in human beings is considered to be one of the most serious crimes in which there is a significant violation of fundamental human rights. Through recommendations and binding documents, international organisations call on states to prevent human trafficking, and if it occurs, to allow for the settlement of human rights of its victims. National governments are responsible for compliance with human rights commitments, not only on the level of policy formulation, but also in terms of their implementation in practice. However, experience of social work with trafficked persons in the Czech Republic shows that victims of this serious crime have no access to settlement of their rights. The aim of this paper was to evaluate whether the Czech Republic meets the selected human rights standards that ensure the victims' access to their rights. The evaluation of the situation was based on the selected criteria defining the meeting of individual human rights standards of the Aim for Human Rights organisation. Fulfilling the selected criteria was examined on the case of proceeding of state authorities in the case of exploitation of hundreds of foreign workers in the forestry industry, known as the "Stromkaři" (Tree Workers) case. Interpretative phenomenological analysis of the experience of trafficked people

This thesis focuses on the topic of human trafficking and exploitation from the perspective of the trafficked persons themselves. Using the interpretative phenomenological analysis seeks to determine the lived experience of these people. Data were obtained through semi-structured interviews with 4 respondents who are clients of the organization La Strada ČR. These interviews were recorded and they were subsequently analyzed according to IPA. Trafficking and exploitation had a significant impact on the lives and experiences of these people. Interpersonal relationships are affected the most, especially the ability to establish contacts with strangers. Also relationships with families are disturbed because of fear of rejection and misunderstanding of what you went through. People live in fear for their safety and future. Interpersonal relationships are on the other side one of the elements helping to manage the traumatic event and their absence deepens negative experiences. of the thesis Introduction: The topic of those who have been victims of human trafficking and who are also addicted to drugs is something not yet deeply investigated. The prevetion, intervention and social services for those who are both drug addicts and victims of human trafficking should be based on good knowledge of the situation each of thier particular needs. Helping organizations for this population of people report that from thier expereinces, this is a situation that continues to become more problematic. It is important to be aware of these situations in order to improve them. Victims of human trafficking who also struggle with drug addiction is a situation that deals with many types of needs. It is important to understand each of those comprehensively to fully help the people to return to a social life. Claim: The aim of this work is to describe the various barriers that people face when looking to access addiction rehabilitation centers. Victims of human trafficking: Access to justice as Public Policy issue

The dissertation offers a complex insight into the workings of provisions regarding the policy in the area of combating human trafficking with a focus on the tools which should guarantee access to justice for victims of human trafficking in the Czech Republic. By means of an event analysis covering the years 1993-2013 and using the theoretical premises of Actor-Centred Institutionalism and Social Construction of Target Groups, the paper shows that most institutions and actors active in the observed area of the policy are primarily focused on criminal repression rather than the rights and needs of human trafficking victims. Even the position of the victim is rather weak in the observed segment of the policy in comparison to the declaratory stances. In relation to actors and institutions, the position of the victims is strengthened by the Act on Social Services and weakened, besides other things, by several institutionalized uses of the human trafficking concept. In practice, the group which reaches help and rights is narrowed by them, and, at the same time, they act as an uncertainty factor in the work of Law Enforcement Authorities and other actors. Organized crime - Trafficking in human beings This thesis deals with the criminal offence of trafficking in human beings under Sec. 168 of the Czech Criminal Code. A trafficking in human being is not a frequent criminal offence but with its consequences belongs to the most dangerous crimes. After the Velvet revolution the relevance of this crime has raised subsequently and therefore the regulation of this crime requires particular attention. It is important to find new ways and improve current methods to be readier to detect and investigate the cases of trafficking in human beings. The aim of this thesis is to provide an analysis of legal regulation of trafficking in human beings, organized crimed and methods of investigation and some related issues such as problematic of the protection of the witness. This thesis consists of three chapters. The first one deals shortly with the organized crime. It analyzes the term of the organized crime, because trafficking in human beings is usually committed by organized groups. I try to explain some basic terms related to this topic. Implementation and compliance with international standards on human trafficking

At present, human trafficking is a very lucrative business. It is the third largest illegal market after the trade in arms and drugs, even some authors suggest that in the near future it could get in the first place "in the ranking." For what reason is the trafficking in human beeings so profitable and how states are trying to tackle this phenomenon? What does actually human trafficking involve and what are its impact on the current global world? Although there is a wide range of initiatives and programs, a deeper analysis of the actual situation in the States shows that neither the process of implementation of international standards nor the law enforcement is going smoothly. The aim of my work is to illuminate the phenomenon of human trafficking in regions of Africa and Europe with regard to the operation of international and non-governmental organizations. Firstly to point out that there are some shortcomings in the implementation and compliance with laws on trafficking in persons by States, and secondly that human trafficking is not only the problem of developing world, but it is a growing global problem involving currently also the developed states. The fight against trafficking in human beings requires global action and cooperation of various actors of international relations. It would be more desirable to have a clooser cooperation of international organizations and States particularly in the field of implementation and law compliance.
PREVENTION OF HUMAN TRAFFICKING CONDUCTED AT SECONDARY SCHOOLS

Even though 79% of the surveyed students claim they have heard the term ``human trafficking{\crq}q, only 14% can define this term accurately. On the basis of the information obtained, a conclusion was arrived at that the level of information about human trafficking among students at Kolín-district secondary schools is inadequate. The students themselves said in their opinions that they did not have enough information about human trafficking, thus confirming this fact. The benefit and sense of this dissertation was to map the still uncharted territory of Kolín-district secondary schools from the viewpoint of human trafficking and to conduct a lecture. Compared to other issues, the prevention of human trafficking is neglected. Therefore, lectures should be conducted on this issue, which should even be integrated into the curriculum, in particular in the subjects of citizenship and the basics of social sciences.
Trafficking in human beings as a way of strengthening the market competitiveness of the Czech Republic?

The thesis considers trafficking as a way of strengthening the market competitiveness of the Czech Republic. Contrary to wide-spread approach to this issue, only as to violation of the rights of victims, trafficking is examined from the side of entrepreneurs and from the side of impact on national competitiveness. In addition to factors affecting the national economy and the motivation of entrepreneurs is evaluated the efficiency of subsidies provided by the Ministry of the Interior to Programme of the support and protection for victims of trafficking. In the thesis is found out that the exploitation of trafficked persons increases competitiveness of the Czech Republic, because it fills gaps on the domestic labour market with no wage increases. For employers victims are flexible and low-cost source of labour force, which increases productivity of their firms, but they don't represent significant competition for legal workers in the country.
