The Protectorate Government in the administration system of the Protectorate of Bohemia and Moravia

This State Doctoral work is focused on the era of the so-called Protectorate of Bohemia and Moravia, operational during the period March 16, 1939 to May 5, 1945. Concretely, it is aimed at describing and analyzing the structure of the public administration of the Protectorate of Bohemia and Moravia with emphasis on the position of the Protectorate Government as the most important component of the autonomous protectorate administration. The work is, above all, devoted to the organization and scope of powers of the Protectorate Government, and defines its position toward the main parts of the German occupation administration, both in light of the legal regulation and the factual situation. Furthermore, the work observes in detail the function of the Protectorate Government, especially its legislation activity in the most important fields of economic, social and public life or in "the solving of the Jewish problem". This work also outlines the personal occupation of the Protectorate Government and its changes, and differentiates between particular Protectorate Governments, as well as between particular members of these Protectorate Governments in their attitude toward the Nazi occupation power on one hand, and toward the Czech national resistance on the other. This thesis aims to analyze legislation of the Czech legal order concerning religious freedom. The work is divided in 4 parts. The first part of the thesis deals with the definition of religious freedom in the first place. Afterwards the thesis describes the Constitutional law relating to the religious freedom (especially the Article No. 15 and No. 16 of the Charter of the Fundamental Rights and Freedoms of the Czech Republic), international conventions relating to the theme (e.g. The Universal Declaration of Human Rights, The International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights etc.) and further statutory provisions and legislative rules guaranteeing religious freedom in the Czech Republic. Major part of the thesis relating to the statutory provisions and legislative rules deals with the act No. 3/2002 Coll., on Freedom of religion and the status of churches and religious societies, as amended. The act No. 3/2002 Coll. constitutes basis of regularization of the freedom of religion in the Czech Republic. Shrnutí Diplomní práce s názvem Prezident republiky v ústavním systému předmnichovské ČSR se zabývá ústavním postavením prezidenta republiky v době první republiky, tj. v letech 1918 - 1938 a to po stránce formálně ústavní, avšak i z hlediska jeho faktického postavení. Autor v diplomní práci naznačuje slabší formální postavení prezidenta republiky v tzv. prozatímní ústavě z roku 1918 ( zákon č. 37/1918 Sb. z. a n. ze dne 13. listopadu 1918, o prozatímní ústavě ) a jeho poněkud silnější formální postavení v Ústavní listině z roku 1920 ( zákon č. 121/1920 Sb. z. a n. ze dne 29. února 1920, kterým se uvozuje Ústavní listina Československé republiky ) a dále v práci zdůrazňuje velmi silné faktické postavení prezidenta republiky Tomáše Garrigue Masaryka plynoucí z jeho silné osobnosti, avšak i s ohledem na jeho zásluhy o vznik Československé republiky a z jeho všestranných morálních předpokladů pro výkon této funkce. Silné faktické postavení prezidenta republiky je vysvětleno na jeho vztahu k vůdcům státotvorných politických stran uskupených v neformální koalici zvané " pětka", kterými byl první prezident pro svoji autoritu respektován. The material core of the Constitution - Abstract This thesis is about the relation between the state of the Czech Republic and Czech and Czechoslovakian constitutional area. The deciding impulse leading to the elaboration of this topic was historically the first derogation of constitutional act by the Constitutional Court of the Czech Republic. The reason of the groundbreaking judgement was the conflict of the challenged constitutional act and the material core of the Constitution which protects its democratic frame. The aim of the thesis is to explore the form, content and protection of the most important constitutional base of the Czech Republic, i.e. the imperative of inflexibility of the democratic state law material attributes. The way how to deal with that is to review historical and revolutionary changes of the legal state principle. The first part of the thesis concentrates on fundamental historical events which resulted in the reversal of the legal state concept. The relationship between the state and church in the post-war history of Czechoslovak and Czech nationhood. A comparison of the legal status of churches under the Communist regime and today

Resume The goal of this paper is to describe the situation of churches and religious societies with respect to the legal system, through the changes that affected the Czech legal systém throughout the recent half of the century. Because it is impossible to fully deal with the entirety of the history of state and law over the century, it will focus on the developments during the totalitarian regime of the Communist party and on the results thereof. The main goal is therefore to make a comparison, this will be a comparativistic endeavor, and there will not only statutes and legal documents be described, but also the practical applications of these statutes and documents, and there will be focus on theoretical and constitutional basis behind the laws. Unfortunately, with the constrains of the current format, it is impossible to fully describe even one era of Czech statehood, therefore there will be an arbitrary selection of topics on which the facts will be demonstrated and from which they will be extrapolated. The other topics will only be adressed to in a general manner. Also, it is not possible to include in full the divergent approaches of law towards the various individual churches. - Constitutional aspects of the termination of the Czechoslovak Federation The thesis deals with problems of constitutional aspects relating to termination of the Czechoslovak Federation, which was abolished on 31.12. 1992 I have chosen this theme because I am interested in this theme since the first grade of my studium at the Law faculty. I had better access to this theme after the attendance of Scientific seminar leaded by Doc. Gronský called Slovakia in constitutional history of Czechoslovakia. The thesis uses sources available to students of Law faculty (monography, collections, university textbooks, texts of laws, articles, stenograph records, university lectures). The thesis is grounded on the synthesis of many sources with emphasis on consistent citing sources of the original authors. The thesis is composed of three chapters, which are divided into subchapters. These subchapters contain parts. Ondřej Šťastný Rigorózní práce se zabývá vybranými aspekty svobody projevu tak, jak je vymezena v našem právním řádu a v právu mezinárodním a evropském. Zvláštní pozornost věnuje limitům svobody projevu a střetům tohoto politického práva s jinými základními právy. Významná část práce je věnována detailnímu rozboru zásadních judikátů, které v posledním desetiletí formovaly podobu a meze svobody projevu v České republice. Konkrétně jde o vesměs hojně veřejně diskutované kauzy, ve kterých figurovala média. Jsem přesvědčený, že je to právě konkrétní soudcovské dotváření práva, kde lze vysledovat mnoho inspirativních právně-filosofických názorů na to, jak má svoboda projevu v naší (stále ještě mladé) demokracii vypadat.
