I když už byla i tato norma p ijata ve své definitivní podob , stále ješt nenabyla ú innosti a práce se tak dotýká problematiky nejen de lege lata, ale i de lege ferenda. Oblast energetiky je sektorem, ve kterém se stále intenzivn ji st etávají zájmy lenských stát a Spole enství. Bylo tedy zajímavé sledovat, jakým zp sobem docházelo a dochází k vzájemnému ovliv ování komunitárního právního ádu a obou ád národních. Díky svým jazykovým možnostem jsem byl navíc schopen p i srovnávání národních právních úprav vycházet p ímo z p vodního zn ní t chto pramen . Toto všechno jsou aspekty, které se ur itým zp sobem v mé práci prolínají. Ve své práci jsem postupoval za použití komparativní metody. Vybral jsem si dva státy Spole enství, které vyznávají výrazn odlišné p ístupy k danému problému. The Right to the Protection of Personal Data in Article 8 of the Charter of Fundamental Rights of the European Union

This thesis deals with the fundamental right to the protection of personal data as enshrined in Article 8 of the Charter of Fundamental Rights of the European Union ('the Charter'). An analysis of the case law of the Court of Justice of the European Union (CJEU) on Article 8 of the Charter reveals an intriguing paradox: although this provision has been repeatedly invoked in order to enhance protection of personal data and has featured prominently in several far-reaching judgments (Digital Rights Ireland, Google Spain or Schrems), there is considerable uncertainty as to the substantive scope of the right to the protection of personal data. The relationship between the right to privacy and the right to data protection has proved difficult to untangle, and the autonomous nature of Article 8 of the Charter has not always been respected. The aim of the thesis is to analyse the purpose and content of this fundamental right with reference to the CJEU's case law and recent academic debate. This thesis is divided into four chapters. Locus standi of non-privileged applicants to bring an action for annulment Abstract Every developed legal system is bound to have a mechanism for checking the procedural and substantive legality of measures adopted by its institutions. In the European Union it was of significant importance to create a system of control over the acts of the EU institutions given the democratic deficit within the Union and the limited supervisory role of the European Parliament. Binding acts of the EU institutions are subject to review through a number of routes provided by the Treaty on the Functioning of the European Union (TFEU) and the Treaty on the European Union (TEU), namely action for annulment (Art. 263 TFEU), the plea of illegality (Art. 277 TFEU), the preliminary reference (Art. 267 TFEU) and the action for damages (Arts. 268 and 340 TFEU). The Court has consistently endeavoured to treat the several strands as a complex and coherent system of judicial review within the Union based on the rule of law. Selected issues of the citizenship of the EU The aim of this paper is to analyse selected issues of the evolution and practical importance of the EU citizenship. Study is focused mainly on right to move and reside freely within the European Union as this right became the most significant for the ordinary citizen. The thesis is composed of five chapters, each of them dealing with different aspects of the EU citizenship. Chapter One is introductory and subdivided into two main parts of which one defines the notion of the citizenship within the national context and the other deals with the same notion within the EU context. It also breafly examines the question of European identity, which is closely related to the notion of the EU citizenship. Chapter Two focuses on the evolution of the EU citizenship starting in the 1970's as a part of European political integration. It examines the most important milestones of this notion's evolution. Main part of this chapter focuses on the post- Maastricht period and changes brought by founding Treaties amendments. The impact of Directive 2004/38 upon the free movement of nationals of the European Union with regard to relevant case-law of the European Court of Justice This diploma thesis deals with impact of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States on the freedom of movement. The first chapter of thesis aims to cover main points of development of the right to free movement. From the right of workers as an economic factor to the general right of every citizen of Europe. As far as the introducing of the European Union Citizenship was very important point for the development of right to free movement, this chapter also concerns evaluation of this phenomenon. E-procurement in the Member States of the European Union This paper aims to systemise data of e-procurement with regard to the legal rules in the Member States of the Eumpean Union, eSpecially in the Czech Republic. The objective of this thesis is to provide a comparison of the situation in public procurement across and within the Member States. In the EU, there were adopted new Procurement Directives, 2004/ l 7/EC and 2004/18/EC, in April 2004. Member States were required to implement the new legal framework by 31 January 2006, but slippages were not excluded. Early adoption of the new e-procurement provisions is essential to avoid barriers to and distortion of competition. The Directives provide a coherent framework for conducting procurement electronically in an Open, transparent and non-discriminatory way, establish rules for tendering electronically and fix the conditions for modern purchasing techniques based on electronic means of communication. The implementation of Directives' provisions on a dynamic purchasing system and e-auctions is optional. However, most of the Member States have introduced these procurement procedures.
