1 Ochrana před nečinností správních orgánů Abstrakt Tato diplomová práce se zabývá systémem ochrany před nečinností správních orgánů tak, jak je zakotven v českém právním řádu. Nečinnost správních orgánů ve správním řízení je stále přítomným fenoménem, který je ovšem způsobilý zásadním způsobem zasáhnout do práv a oprávněných zájmů účastníků těchto řízení. Z tohoto důvodu je třeba danému tématu věnovat dostatečnou pozornost. Diplomová práce tedy komplexně popisuje ochranu před nečinností správních orgánů poskytovanou českým právním řádem a navrhuje možné de lege ferenda návrhy právní úpravy k jejímu zefektivnění. Postupuje logicky od ústavního a mezinárodněprávního zakotvení výchozích principů této ochrany. Zabývá se průtahy v již zahájeném správním řízení, přičemž se blíže věnuje obsahu a výkladu pojmů přiměřené lhůty podle § 6 odst. 1 správního řádu a vydání rozhodnutí bez zbytečného odkladu podle § 71 odst. 1 správního řádu, a to s ohledem na judikaturu českých soudů i Evropského soudu pro lidská práva. Dále rozebírá i absolutní nečinnost správních orgánů. Pozornost je věnována ochraně před nečinností správních orgánů podle § 80 správního řádu, která je nejdříve popsána a následně se práce blíže zabývá žádostí o uplatnění opatření proti nečinnosti podle § 80 odst. 3 správního řádu a jednotlivými... 1 Protection against Inaction of Administrative Authorities Abtract This thesis focuses on the issue of protection against inactivity of administrative authorities within the Czech legal system. The inactivity of administrative authorities in administrative proceedings remains a relevant phenomenon, which is, however, capable of fundamentally affecting the rights and legitimate interests of the participants involved. Therefore, it is important to devote adequate attention to this issue. This thesis provides a comprehensive overview of the protection mechanisms against administrative inactivity provided by the Czech legal order and proposes possible de lege ferenda adjustments to enhance its effectiveness. It proceeds logically, starting with the constitutional and international legal foundations of these protective measures. The analysis extends to delays occurring in ongoing administrative procedures, with a particular focus on defining and interpreting the notion of a reasonable timeframe as stipulated in Paragraph 6(1) of the Administrative Procedure Code. Additionally, it examines the prompt issuance of decisions, in accordance with Paragraph 71(1) of the Administrative Procedure Code, taking into account precedents from Czech courts and the European Court of Human Rights.
