Právní úprava svobody pohybu ve zvláště chráněných územích Abstrakt Diplomová práce se zabývá právní úpravou svobody pohybu ve zvláště chráněných územích, zejména jsou tedy zkoumána omezení svobody pohybu zákonem o ochraně přírody a krajiny. Aktuálnost tohoto tématu spočívá v důsledcích epidemie Covidu-19, médiím zprostředkovávajícím nápady a trendy navštěvovat lákavá území a technologickému pokroku, který dělá těžko dostupná místa snadněji dostupnými pro širší okruh osob. Cílem práce je rozbor aktuální právní úpravy zvláště chráněných území a zhodnocení přiměřenosti a naplňování účelu omezení základní svobody pohybu touto legislativou. Diplomová práce podává výklad o základní svobodě pohybu, právní úpravě práva obecného užívání přírody a krajiny a zvláště chráněných území, organizaci ochrany přírody a krajiny a nástrojích ochrany přírody a krajiny. Práce se zabývá koncepčními nástroji. Blíže jsou rozebrány administrativní nástroje ochrany, omezení svobody pohybu zákonná i správním aktem, také s uvedením konkrétních příkladů chránících zvláště chráněná území před nešetrným pohybem osob, dále ekonomické a sankční nástroje ochrany, zaměřené zejména na vybírání poplatků za vstup a na odpovědnost za spáchaný přestupek. Co do stanovených cílů této diplomové práce bylo dospěno k závěrům, že ochrana zvláště... 1 Legislation of freedom of movement in Special Protection Areas Abstract The thesis is covering the legislation of freedom of movement in Special Protection Areas, in particular the limitations of freedom of movement embedded it the Act on the Protection of Nature and Landscape are examined. The timeliness of this topic lies in the consequences of the Covid-19 epidemic, the media conveying ideas and trends to visit attractive territories and technological progress that provide easy access to inaccessible places for a wide range of people. The aim of the thesis is the analysis of the current legal regulation of Special Protection Areas and the assessment of the adequacy and fulfillment of the purpose of the limitation of fundamental freedom of movement by this legislation. This thesis provides an explanation of the fundamental freedom of movement, the legal regulation of the right of public use of nature and landscape and Special Protection Areas, the organization of nature and landscape protection and the instruments of nature and landscape protection. The thesis covers conceptual tools. In detail are discussed administrative instruments of protection, restrictions on freedom of movement provided ex lege and ex actu, also with specific examples protecting Special Protection Areas from the unresponsible...
