Tato diplomová práce se zabývá specifiky vlastnictví pozemků ve zvláště chráněných územích. Cílem bylo zjistit, jaké je postavení vlastníků pozemků ve zvláště chráněných územích. Práce je zaměřena především na podmínky, povinnosti a omezení, které dopadají na vlastníky pozemků ve zvláště chráněných územích, včetně kompenzací, které jim za taková omezení náleží. Práce také představuje některé další instituty, které mohou být při ochraně přírody a krajiny využity. Jsou analyzovány právní předpisy veřejného i soukromého práva, s důrazem na právo veřejné, jehož součástí jsou i právní předpisy upravující ochranu přírody a krajiny. Využita je i judikatura, která řeší oblast ochrany přírody a krajiny a vlastnického práva. Hlavní částí práce je analýza specifických práv a povinností pro vlastníky pozemků ve zvláště chráněných územích. Práce také rozebírá postavení vlastníků při samotném vyhlašování zvláště chráněných území. Zmíněny jsou i kompenzace, které vlastníkům v případě omezení jejich vlastnického práva z důvodu ochrany přírody a krajiny náleží. Záběr tématu je značně široký, proto byla zmíněna ta nejdůležitější specifika. V práci je rovněž nastíněno, jakým způsobem by se v některých případech mohla právní úprava vylepšit. The objective was to determine the status of landowners in these protected areas. The study primarily concentrates on the conditions, obligations, and restrictions that affect landowners in these areas, including the compensations they are entitled to for such restrictions. The thesis also introduces some other institutions that can be used in the protection of nature and landscape. Legal regulations of both public and private law are analyzed, with an emphasis on public law, which includes legal statutes regulating the protection of nature and landscape. Case law addressing the area of nature and landscape protection and property rights is also utilized. The main part of the thesis is an analysis of specific rights and duties for landowners in specially protected areas. It also discusses the position of landowners in the actual declaration of specially protected areas. Mentioned as well are compensations due to owners in case of limitations on their property rights for the purpose of protecting nature and landscape. Given the broad scope of the topic, only the most important specifics are mentioned. The thesis also outlines how legal regulations could be improved in certain cases.
