[cze][eng] Obec a ochrana životního prostředí z pohledu práva Abstrakt Hlavním cílem této práce je poukázat na důležitost role obcí v procesech ochrany životního prostředí. Jak by mělo být z práce patrné, oblast ochrany životního prostředí v poslední době prochází vcelku dynamických vývojem ať již v oblasti legislativní či judikaturní a obce jsou nuceny na tento vývoj také reagovat. Obsahem první kapitoly je vymezení pojmu životního prostředí a subjektivního práva fyzických a právnických osob na příznivé životní prostředí, zejména s ohledem na problémy, které se objevily v souvislosti s otázkou, zda subjektivní právo na příznivé životní prostředí náleží i právnickým osobám či nikoliv. Součástí první kapitoly je také komparace ústavní úpravy české s úpravami některých dalších evropských demokracií, ze které vyplývá závěr zdařilosti naší ústavní úpravy. Druhá kapitola popisuje obce jakožto subjekty státní správy, jejich dělení a hlavní náplní druhé kapitoly je pak rozlišení samostatné a přenesené působnosti. V druhé kapitole je také poukázáno na fakt, že role obce jako procesního subjektu se rozpadá do třech oblastí a tyto oblasti, ač jsou laickou veřejností často směšovány, stojí na odlišných základech. Třetí kapitola popisuje již konkrétní nástroje, kterými obce působí v různých procesech dotýkajících se životního...Municipality and environmental protection from the legal point of view Abstract The main goal of this work is to show the importance of the role of municipalities in the processes of environmental protection. As should be clear from the work, the field of environmental protection has recently undergone quite dynamic development, both in the legislative and case law, and municipalities are forced to respond to this development. The content of the first chapter is the definition of the concept of the environment and the subjective right of natural and legal persons to a favorable environment, especially with regard to the problems that have arisen in connection with the question of whether the subjective right to a favorable environment also belongs to legal persons. Part of the first chapter is also a comparison of the Czech constitutional regulation with the legislatives of some other European democracies, which concludes the success of our constitutional regulation.
