Tato diplomová práce se zabývá věcným břemenem podle ust. § 28d zákona č. 42/1992 Sb. a jednotlivými instituty a otázkami, které s tímto věcným břemenem souvisí. Práce by měla představovat komplexní analýzu tohoto právního institutu, nejen z hlediska teoretického, ale i z hlediska soudní praxe, především za využití teoretického výkladu, který je provázen judikaturou. Problematice tohoto věcného břemene není v současné literatuře věnována přílišná pozornost, ačkoli se jedná o otázku současnou a velmi komplikovanou. Práce je rozdělena do tří částí. První část se zaměřuje na obecné otázky bytové výstavby a družstevní bytové výstavby. Pozornost je věnována především otázkám družstevní komplexní bytové výstavby, v rámci které došlo k výstavbě nástaveb a vestaveb na budovách a v budovách ve vlastnictví třetích osob. Pohled do historie poskytne čtenáři obraz situace, v níž ke speciální družstevní bytové výstavbě došlo. Druhá část diplomové práce se věnuje věcným břemenům v platné právní úpravě. Pozornost je věnována zejména služebnostem, které svým obsahem a podstatou odpovídají předmětnému věcnému břemeni. Třetí část se již podrobně zaměřuje na věcné břemeno podle ust. § 28d zákona č. 42/1992 Sb. Čtenáři je poskytnut teoretický výklad o právní úpravě dané problematiky, o vzniku této úpravy a o důvodech a účelu... This thesis deals with the easement pursuant to Section 28d of Act No. 42/1992 Coll. and individual institutes and issues related to this easement. The thesis should represent a comprehensive analysis of this legal institute, not only from the theoretical point of view, but also from the point of view of court practice, especially using theoretical interpretation, which is accompanied by case law. The issue of this easement is not given much attention in the current literature, although it is a contemporary and very complicated issue. The thesis is divided into three parts. The first part focuses on the general issues of housing construction and cooperative housing construction. Attention is paid in particular to the issues of cooperative complex housing construction, which involved the construction of extensions and additions on buildings and in buildings owned by third parties. A look at the history will give the reader a picture of the situation in which special cooperative housing construction occurred. The second part of the thesis deals with easements in the current legislation. Attention is paid in particular to servitudes, which in their content and nature correspond to the easement in question.
