Teorie, praxe a perspektivy pěstounské péče v České republice Abstrakt Diplomová práce se zabývá problematikou pěstounské péče, jakožto tradičního soukromoprávního institutu náhradní rodinné péče, který však nese také výrazné veřejnoprávní rysy. Cílem práce je poskytnout ucelený pohled na právní úpravu pěstounské péče de lege lata nejen po stránce teoretické, ale též poukázat na některé praktické důsledky aplikace předmětné právní úpravy. Část práce je věnována také perspektivám vývoje právní úpravy pěstounské v návaznosti na připravované legislativní změny v oblasti náhradní péče o děti. Nemohou-li z objektivních či subjektivních důvodů o dítě osobně pečovat jeho rodiče, musí stát dítěti zajistit vhodnou péči náhradní. Jednou z těchto forem náhradní péče je pěstounská péče, která poskytuje řešení onoho nedostatku péče o dítě ze strany jeho rodičů v prostředí rodinu co nejvíce připomínajícím. Z tohoto důvodu pěstounská péče zaujímá v systému náhradní péče nezastupitelné místo. Nejprve diplomová práce poskytuje stručný výklad o historii a vývoji pěstounské a její právní úpravy na území České republiky s přihlédnutím k významným historickým mezníkům. Cílem druhé kapitoly je poskytnout přehled forem náhradní péče o dítě tak, jak je rozeznává zákon č. 89/2012 Sb., občanský zákoník, se zaměřením na pěstounskou... Theory, practice and prospects of foster care in the Czech Republic Abstract The thesis deals with the issue of foster care, as a traditional private law institute of alternative family care, which has significant public law features. The aim of the thesis is to provide a comprehensive view of the legal regulation of foster care de lege lata not only from a theoretical perspective, but also to point out some practical consequences of the application of the legal regulation in question. Part of the thesis is also devoted to the prospects of regulatory developments of foster care following the upcoming legislative changes in the field of alternative care for children. If, from objective or subjective reasons, the child's parents cannot personally care for the child, the state must ensure a suitable alternative care for such a child. One of these forms of alternative care is foster care, which provides a solution to the lack of personal care for child by his or her parents in an environment that resembles a family as much as possible. That is why foster care holds an irreplaceable position within the system of alternative care for children.
