1 Obhajoba obhájcem v hlavním líčení Abstrakt Cílem této diplomové práce je nejen zanalyzovat právní úpravu týkající se obhájce a obhajoby v hlavním líčení, a poskytnout čtenáři pohled de lege lata na tuto problematiku, ale také uvést u některých právních institutů své úvahy de lege ferenda. Diplomová práce dále poskytuje čtenáři komparaci současné právní úpravy a aktuální verze návrhu nového trestního řádu (stav ke dni 14. 10. 2022) u vybraných trestněprocesních otázek. Obsah práce je rozdělen do úvodu, čtyř částí a závěru. V úvodu je stručně odůvodněn výběr tohoto tématu a stanoveny cíle, kterých má být v diplomové práci dosaženo. Je zde zdůrazněn význam práva na obhajobu a důležitost osoby obhájce. První část práce vymezuje právo na obhajobu, klade důraz na základní lidská práva a svobody v trestním řízení a základní zásady trestního řízení, z nichž akcentuje zásadu zajištění práva na obhajobu. Druhá část práce se věnuje osobě obhájce. Nejprve obecně vymezuje institut obhájce, pak se zabývá konkrétními formami zastupování obhájcem a jeho právy a povinnostmi. Třetí část diplomové práce stručně vymezuje stadia trestního řízení, dále se věnuje obhajobě v hlavním líčení, která je jádrem této práce. Čtvrtá část práce se zaměřuje na odchylky v obhajobě mladistvých, právnických osob a uprchlého, a na stručné... 1 Defence by the defence counsel in the trial Abstract The aim of this thesis is not only to analyse the legal regulation concerning the defence counsel and the defence in the main trial, and to provide the reader with a de lege lata view on this issue, but also to provide de lege ferenda considerations for some legal institutes. The thesis also provides the reader with a comparison of the current legal regulation and the current version of the draft of the new Criminal Procedure Code (as of 14 October 2022) on selected criminal procedure issues. The content of the thesis is divided into an introduction, four parts and a conclusion. The introduction briefly justifies the choice of this topic and sets out the objectives to be achieved in the thesis. The importance of the right to a defence and the importance of the person of the defence counsel is emphasised. The first part of the thesis defines the right of defence, emphasises the fundamental human rights and freedoms in criminal proceedings and the basic principles of criminal procedure, among which the principle of ensuring the right of defence is emphasised.
