Sporné otázky nutné obrany v judikatuře Abstrakt Tato diplomová práce se zabývá spornými otázkami nutné obrany v judikatuře. První část této diplomové práce se blíže zaměřuje na teoretické pojetí nutné obrany, jakožto okolnosti vylučující protiprávnost, kdy je zjištěno, že nezbytnými podmínkami jednání v nutné obraně jsou existence útoku trvajícího anebo přímo hrozícího, který musí směřovat proti zájmu chráněnému trestním zákonem, přičemž útok musí být protiprávní a skutečný, kdy obrana nesmí být zcela zjevně nepřiměřená. Jsou zde popsány i případy vybočení z mezí nutné obrany, kterými jsou exces intenzivní či exces extenzivní. Druhá část této práce se zabývá významem judikatury v trestním právu a jednotlivými vybranými spornými otázkami v nutné obrany řešenými v judikatuře. Nachází se zde jednotlivé ukázky judikátů, a to ve stylu "casebook", kdy je vždy popsán individuální případ, a to ze stránky skutkové i právní, obsahující právní věty i důležité, praktické a zajímavé výtažky ze soudních rozhodnutí. Mezi řešené sporné otázky patří otázka subsidiarity nutné obrany, otázka existence intenzivního a extenzivního excesu z nutné obrany, otázka nutné obrany a provokace či afektu při nutné obraně, otázka použití nutné obrany proti nutné obraně, otázka nutné obrany proti úkonu zaměstnance bezpečnostní služby,... Disputable questions of necessary defence in judicial practice Abstract This diploma thesis deals with disputable questions of necessary defence in judicial practice. The first part of the diploma thesis focuses more closely on the theoretical concept of necessary defence, as a circumstance excluding illegality, when it has been found out that the necessary conditions of the necessary defence are the existence of an ongoing or imminent attack, which must be directed against an interest protected by criminal law, while the attack must be unlawful and genuine, when the defence must not be quite manifestly unreasonable. There are cases of deviating from the limits of necessary defence, which are called excess intensive or excess extensive, described here as well. The second part of this diploma thesis deals with the importance of judicial practice in criminal law and individual selected disputable questions in the necessary defence solved in judicial practice. There are individual samples of court decisions, in the "casebook" style, where an individual case is always described, both factually and legally, containing legal sentences as well as important, practical and interesting extracts from court decisions.
