[cze][eng] Rozhodčí pravidla UNCITRAL a jejich využití v praxi Abstrakt Tato diplomová práce se zabývá Rozhodčími pravidly UNCITRAL a jejich využitím v praxi. Cílem je analyzovat postavení a oblast využiti Rozhodčích pravidel UNCITRAL a dalších norem UNCITRAL v současných podmínkách vývoje mezinárodního obchodu, růstu mezinárodních ekonomických vztahů a v důsledku toho i prohloubení integračních procesů. Pro dosažení cíle jsou použité právně- analytická, právní komparativní a právně-deskriptivní metody. Diplomová práce je rozdělena do dvou části. V první části se čtenář seznamuje s obecným pojetím mezinárodního rozhodčího řízení, s rozhodčí smlouvou jako základem rozhodčího řízení, arbitrabilitou a v neposlední řadě s rozdílem mezi ad hoc a institucionální arbitráži. V druhé části se autorka zabývá Komise UNCITRAL a její role v mezinárodním právu soukromém, provádí se analýza právních aspektu Rozhodčích pravidel UNCITRAL a jejich aktuální novelizace v roce 2010, a také jejich praktická realizace v moderních podmínkách rozvoje mezinárodního obchodu při současném vlivu hospodářských sankcí. V závěru jsou formulovány konkrétní výroky o tom, že další vývoj Rozhodčích pravidel UNCITRAL je nevyhnutelný, použiti Rozhodčích pravidel UNCITRAL a dalších norem UNCITRAL je v současnosti plně realizovatelná nehledě na současnou...UNCITRAL Arbitration Rules and their application in practice Abstract This thesis investigates the UNCITRAL Arbitration Rules and their application in practice. The aim of the thesis is to analyze the extent of the application of UNCITRAL Arbitration Rules and other UNCITRAL rules in the current climate of the development of international trade, the growth of international economic relations and, as a result, the enhancement of integration processes. Legal-analytical, legal- comparative and legal-descriptive methodology is used to address the aforementioned research question. The thesis is divided into two parts. In the first part, the reader is acquainted with the general concept of international arbitration, the arbitration agreement as the basis of arbitration, arbitrability and, last but not least, the difference between ad hoc and institutional arbitration. In the second part, the author covers the UNCITRAL Commission and its role in private international law, investigates the legal aspects of the UNCITRAL Arbitration Rules and their most recent revision in 2010 and their practical implementation in modern conditions of international trade under the current impact of economic sanctions.
