Nabytí věcného práva od neoprávněného k věci evidované ve veřejném seznamu Abstrakt Tato práce se zabývá tématikou nabytí vlastnického práva od neoprávněného k nemovitosti zapsané v katastru nemovitostí na základě právního jednání. Zkoumané téma pak bylo vymezeno v rámci široce zadaného původního tématu. Výzkumný úkol práce spočívá v analýze role a postavení právních principů v uvedené problematice a jejich postavení v jednotlivých obdobích. Předmětem zkoumání je období právní úpravy účinné do roku 2014, kdy v českém právním řádu neexistovala explicitní právní úprava nabytí nemovitosti od neoprávněného a dále období po rekodifikaci soukromého práva v roce 2014. Součástí této rekodifikace byl nový občanský zákoník, v němž již došlo k provedení principu materiální publicity, a tedy zakotvení zákonem zakotvené formy nabytí nemovitosti evidované v katastru nemovitostí od neoprávněného. Diplomová práce je rozdělena celkem do pěti kapitol. První tři kratší tvoří nezbytný obecný úvod do problematiky a obsahují mimo jiné vysvětlení důležitých pojmů, s nimiž je v práci v rozsahu probíraného tématu dále pracováno. První kapitola se zabývá pojmem vlastnického práva, jeho vymezením, relevantní právní úpravou a způsoby jeho nabytí, včetně nabytí od neoprávněného k movité věci. Acquisition of a right in rem from an unauthorised person to a thing registered in a public register Abstract This diploma thesis deals with the topic of the acquisition of ownership right to a real property registered in the cadastre of immovables from an unauthorized person based on a legal conduct. This scope of research was determined within a broad assigned topic. The research task of this thesis consists of the analysis of the role and status of legal principles in the mentioned matter and relevant periods of time. The subject of the research is the legal regulation effective until 2014, under which there was no regulation of the acquisition of the ownership right to a real property from an unauthorized person in Czech legal order, as well as the time period after the great private law recodification came into effect in 2014. As a part of the great private law recodification, the new civil code came into effect introducing fully implemented principle of material publicity, thus the possibility of acquisition of ownership right to a real property from an unauthorized person was established by law.
