Vymezení pojmu věci právním smyslu je stěžejní otázkou nejenom pro občanské právo. Právě na jeho pojetí závisí, které věci se mohou stát předmětem vlastnického práva. Obecně se můžeme setkat se dvěma přístupy v chápání věci de iure. První z nich vychází z úzkého pojetí věcí, kdy chápe věci jako hmotné předměty, které mohou být jako jediné předmětem vlastnického práva. Druhý přístup staví na širokém pojetí věcí a řadí k nim i nehmotné věci jako pohledávky, předměty duševního vlastnictví a jiné nehmotné věci. Občanský zákoník nyní pod věcmi v širším smyslu rozumí vše, co je rozdílné od osoby a slouží potřebě lidí a tímto se oproti obč. zák. č. 40/1964 Sb. přiklání k širokému pojetí. Cílem této diplomové práce je představit vývoj tohoto pojmu na našem území a jeho pojetí nejenom v občanských zákonících, ale i v právní nauce a doktríně. Diplomová práce je rozdělena na čtyři části a věnuje se především vymezení samotného pojmu věci, koncepci věcí hmotných a nehmotných, movitých a nemovitých a jiným pojmům úzce souvisejícími s věcmi. První část představuje historický vývoj pojetí věci na našem území. Druhá a stěžejní část se zaměřuje na právní úpravu věcí v občanském zákoníku č. 89/2012 Sb. a v širších souvislostech rozebírá koncepci a její možné přínosy a nevýhody. Soustřeďuje se hlavně na povahu nehmotných věcí... Legal concept of the term "a thing" is the key matter not only for civil law. The concept defines which things may be subjects to proprietary rights. Generally, there are two approaches in understanding of "a thing" de iure. The first approach is based on the narrow conception of things, which sees things as corporeal objects where only they may be objects of ownership. The second approach is based on the wide conception of things. Therefore, incorporeal things, claims, objects of intellectual property and other incorporeal things fall under the category of things. Nowadays, everything that is different from individuals and legal entities and serves the needs of people is undestanded to be a thing by the Civil Code. Compared to the Civil Code, Act. No. 40/1964 Coll, the new Civil Code favors the wide approach. The aim of this thesis is to introduce the development and the concept of the term "a thing" in our country not only in civil codes, but also in doctrine. The thesis is devided into four parts and mainly describes the very concept of things, the concept of corporeal and incorporeal, movable and immovable things and other terms closely related to things.
