Závěr Cílem této diplomové práce bylo mezinárodní srovnání institutu skončení pracovního poměru ve vybraných zemích EU. O srovnávání jednotlivých úprav jsem se pokoušel v textu průběžně a stejně tak jsem se snažil v jednotlivých částech vždy o formulaci z toho plynoucích závěrů a o vyzdvihnutí rozdílností. Do jaké míry se mi to podařilo, ať posoudí čtenář sám. V Závěru bych se chtěl ještě zamyslet nad institutem skončení pracovního poměru z perspektivy ekonomické krize a nad přínosem mezinárodního srovnávání pro její řešení. Institut skončení pracovního poměru nabývá na významu právě v souvislosti se současnou ekonomickou krizí, kdy je řada zaměstnavatelů nucena hromadně propouštět z organizačních důvodů. Z téhle perspektivy si myslím, že poznatky této diplomové práce mohou být přínosné a to vzhledem k možnosti porovnání rigidity úpravy skončení pracovního poměru v jednotlivých evropských zemích. Jak již bylo uvedeno výše, je přístup českého zákonodárce, který stanoví důvody pro rozvázání pracovního poměru ze strany zaměstnavatele v zákoně taxativně, v EU relativně unikátní. Stejně tak je poměrně "vzácná" jednotná výpovědní doba. Je otázkou, zda taková úprava umožňuje zaměstnavatelům čelit výzvám ekonomické krize a zda nevede k obcházení zákona při propouštění zaměstnanců. Principálně ovšem souhlasím s tím,... The purpose of my thesis is to analyze the ways, how the employment contracts are terminated in the European Union. The method of my research is to briefly analyze the labour codes (statutes) of the particular european countries dealing with the termination of employment contracts and then compare them, determine conclusions and emphasize the differences. During my research I worked mostly with the original statutes/regulations of the particular countries and also with the relevant professional literature. Among the kinds of labour contract terminations I always prefer the notice of termination and I focus on it. I have chosen these countries to compare : Austria, Czech republic, France, Germany, Slovakia and Sweden. I focused my research on the comparison of Germany with Czech republic, which is actually the main part of my thesis. The thesis is composed of six chapters, each of them dealing with different aspects of the termination of employment. Chapter one is introductory and defines basic terminology used in the thesis and also its structure. Chapter two examines the most important international/european legislation and documents concerning the subject of employment termination.
