Rodina je pojem, který existoval, existuje a bude existovat v každé době, v každé společnosti, v každé kultuře. O stálosti vztahů v rodině však nemůžeme hovořit. Vyvíjely se vztahy mezi muži a ženami i mezi rodiči a dětmi. Došlo k zrovnoprávnění mužů a žen. Z dětí, které byly objekty moci otcovské, se staly jedinci, kteří mají svá práva a požívají ochrany. Ústředním tématem mé diplomové práce je právní úprava práv a povinností rodičů a dětí a určení rodičovství. Tyto dvě relativně samostatné části práce se prolínají a jsou spolu spjaty. Bez narození dítěte a určení rodičovství by nemohly vzniknout jednotlivá práva a povinnosti. V první kapitole své práce se zaměřuji na právní úpravu vztahů mezi rodiči a dětmi obecně. V historickém kontextu zmiňuji proměnlivost vztahů v průběhu tisíciletí. Roztříďuji jednotlivá práva a povinnosti podle zákona o rodině (zákon č. 94/1963 Sb.) a občanského zákoníku (č. 89/2012 Sb.). Obě tyto právní úpravy oddělují institut rodičovské (z)odpovědnosti od dalších práv a povinnosti, ať už jde např. o určení jména dítěti či o vyživovací povinnost. Na ty se zaměřuji samostatně ve druhé a třetí kapitole. Druhá část mé diplomové práce je věnována určení rodičovství. Určení mateřství bylo donedávna, i díky zásadě mater semper certa est, vždy jasné, ale díky pokrokům v medicíně,... The family is a term, which is known in each period of history of mankind. It played, playes and will play an important role in life of every individual. It helps to create an identity of individual, a scale of values and principles, which are so necessary for happy life. The topic of my thesis is Rights and Obligations of Parents and Children with Emphasis on Selected Issues of Development of Relationship between Parents and Children. I have chosen this topic because I think that this part of family law is very interesting, especially the questions regarding to the determination of parenthood in the time of the medical breakthroughs. The purpose of my thesis is to analyse Czech legislation with regard to international law. The thesis is composed of six chapters, each of them dealing with different aspects of the relationships between parents and children and the determination of parenthood. Chapter one is introductory. It is subdivided into four parts. Part one deals with history of legislation of relationships between parents and children. Part two describes general features of this relationships. And third and fourth parts sort rights and obligations into groups and analyze the issue of a parental responsibility, which are the basic rights and obligations of parents and children.
