[cze][eng] 67 Závěr Důsledná úprava situací, kdy dochází k mezinárodním únosům dětí je nezbytná jak pro jejich ochranu, tak i pro ochranu těch, kteří mají právo na péči o ně. Dokumenty, jež jsou v této práci rozebrané a jimiž je Česká republika vázána, spolu se souborem soudních rozhodnutí ve specifických případech,95 které úspěšně slouží jako pomocný nástroj v aplikační praxi v mnoha zemích, o tuto ochranu usilují s většími či menšími úspěchy. Celkově se jejich přínos však nedá hodnotit jinak než pozitivně, neboť bez jejich existence by šance na navrácení uneseného dítěte do místa jeho obvyklého bydliště byla více než mizivá. Dle mého názoru tedy největším problémem zůstávají situace, které nejsou mezinárodními úmluvami ani normami ES řešené vůbec. Jsou to právě případy, kdy se obvyklé bydliště dítěte nachází v místě, které není smluvním státem žádné z uvedených úmluv nebo nařízení a kdy je řešení těchto situací ponecháno na kolizních normách mezinárodních práv soukromých daných států. Nelze říci, že řešení, ke kterým je na základě takových docházeno jsou vždy špatná, či mohou-li vůbec být za špatná v právním i morálním smyslu považovaná. Pokud však vycházíme z premisy, že mezinárodní úprava únosů dětí obsažená například v Úmluvě, která je závazná pro 69 států ze všech koutů světa a na které se tak takové množství...74 Abstract The international legal regulation of civil aspects related to wrongful removals of children The purpose of my thesis is to analyse international documents related to wrongful removal of children. The reason for my research is that the number of wrongful removals of children is increasing and therefore it is necessary to govern their solutions with a strong international rule of law, main purpose of which is to protect the welfare of minor children. This thesis is composed of five chapters, each of them dealing with different aspects of subject matter. Chapter One explains in general terms of international abduction of children or the wrongful removal of children. Chapter Two deals with the main documents that govern disputes, arising out of international abductions of children, in 69 countries all around the world. It is Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction. This chapter consists of the history of Convention's creation, it's subject, purpose and terminology, together with an analysis of every provision of Convention.
