Hodnoty, právní vědomí a právo Tato diplomová práce se zabývá právními hodnotami a jejich významem při rozhodování subjektů práva. Nejprve zavádí obecný model světa, který je převoditelný na kterýkoliv jiný konzistentně působící svět. Vyvozuje, co můžeme považovat za jednotlivce a jak se tito jednotlivci chovají. To, koho považujeme za jednotlivce, závisí na naší subjektivní volbě. Při určité subjektivní volbě jednotlivce můžeme vztah k okolí jednotlivce vyjádřit určitým myšlenkovým postojem. Pokud můžou sobě odpovídající myšlenkové postoje být sdíleny různými jednotlivci tak, že jejich sdělení jedním jednolivcem by odpovídalo určité myšlence u jiného jednotlivce, mluvíme o institucích. Instituce nepovažujeme za objektivně existující, ovšem pomáhají nám k interpretaci objektivních skutečností. Mezi instituce patří fyzické i právnické osoby, stát i právo. Stát vzniká mocenským způsobem, ovšem pod vlivem morálky. Morálka je druh instituce, která vzniká interakcí jednotlivců a kompromisem mezi jejich usilováním. Tato diplomová práce se přiklání ke konsekvencionalistickému pojetí morálky, přičemž jednotlivé námitky proti konsekvencionalismu buď vyvrací, nebo ukazuje, že je lze na konsekvencionalismus převést. Dále ukazuje, že nelze objektivně určit, koho považovat za právní subjekt, ovšem volba... Values, legal consciousness and law This thesis deals with legal values and their importance for the decision making of legal subjects. First it introduces a general model of a world, which can be used for any world with consistent effects. From that it deduces what can be considered an individual person and how such individuals behave. Who we consider an individual is dependent on our subjective choice. While choosing a particular individual we can express their relationship to their environment with a certain attitude of thought. If mutually corresponding thought attitudes can be shared by different individuals in such a way that the conveyance of them would correspond to a certain thought of a different individual, we use the term institution. Institutions are not considered to be existing objectively, however they help us interpret objective facts. Institutions include natural and artificial persons, the state and the law. The state emerges in a power struggle, although under the influence of morality. Morality is a type of institution, which is created by an interaction among individuals and through a compromise between their aspirations.
