Závěr Úkolem této práce bylo první ucelené zpracování tématu "jmenovací pravomoce prezidenta republiky podle Ústavy ČR a jejich komparace s ústavní listinou z roku 1920". Tato práce si nekladla za cíl rozebrat a prozkoumat všechny jmenovací pravomoci prezidenta, jak na základě platné Ústavy, tak podle ústavní listiny z roku 1920, což ani s ohledem na rozsah práce nebylo možné. V práci jsem se soustředila na vybrané pravomoce, které jsem považovala za nejpodstatnější. Vzhledem k rozsahu práce nebyly vybrané pravomoce rozpracovány do všech detailů, ale byly pouze uvedeny hlavní problémy a fakta s nimi související. Z provedeného srovnání je jednoznačně patrná návaznost obou dokumentů. Pravomoce prezidenta v obou historických obdobích vykazují výrazné shody. Přesto lze konstatovat, že pravomoce prezidenta dle současné Ústavy ČR vykazují určité "oslabení". Jako příklad tohoto "oslabení" můžeme uvést pravomoc prezidenta jmenovat a odvolávat vládu. V čl. 62 písm. a) Ústavy se odděluje předseda vlády od dalších členů vlády: "Prezident republiky jmenuje a odolává předsedu a další členy vlády a přijímá jejich demisi, odvolává vládu a přijímá její demisi," a dále upřesněno v čl. 68 odst. 2. Ústavy "Předsedu vlády jmenuje prezident republiky a na jeho návrh jmenuje ostatní členy vlády…". Jak můžeme dovodit... Appointment powers of the President of the Republic under the Constitution of the CR and its comparison with the Constitutional Instrument of 1920 Abstract The purpose of this thesis is to analyze and summarize appointment powers of the President of the Republic under the Constitution of the Czech Republic and compare them with the appointment powers of the President under the Constitutional Instrument of 1920. This topic was chosen because the valid Constitution of the Czech Republic is based on the Constitution Instrument of 1920 and the two constitutions in question are similar. In closer look those similarities are not so strong and differences maybe seems small but they are significant. This thesis is composed of four chapters. Chapter one is dealing with overall questions around the appointment powers of the president. It is divided to two parts. One is mentioning deputization of the president. Second is handling responsibilities of the president and counter-signature. Second chapter describes common appointment powers which occur in both Constitutions. It is divided into four subchapters. President and his relationship to executive, judiciary, constitutional authorities and other appointment powers. Each subchapter consist many parts regarding the power in question.
