Abstrakt: [cze][eng] Tato práce se zabývá právním postavením občana při obraně České republiky. Shrnuje práva a povinnosti občana na tomto poli a snaží se o zachycení možných nedostatků v soudobé legislativě. Za tímto účelem jsou v první kapitole nejprve rozebírána teoretická státovědní východiska vztahu státu a občana při zajišťování obrany. Je zde popsán význam obrany a důvody, proč by se jí měl stát zabývat. Jsou zde využívány jak klasické státovědní teorie, tak i současná doktrína. Druhá kapitola zachycuje soudobé ústavní zakotvení obranné a bezpečnostní problematiky. Jsou zde popsány základní ústavní principy, které determinují podobu obranné legislativy a pozici občana v ní. Zvlášť je zde řešena současná doktrína omezování základních práv a svobod z důvodu bezpečnosti. Dále jsou zde popsány jednotlivé mimořádné stavy se zvýšenou pozorností věnovanou stavu ohrožení státu a válečnému stavu, které jsou přímo spojeny se zajišťováním obrany České republiky. V třetí kapitole jsou již řešeny jednotlivé zákony, které se dotýkají problematiky obrany. Pozornost je věnovaná zejména jednotlivým povinnostem a právům, které tato právní úprava občanům ukládá, metody, jakými tak činí, a sankce, které za nesplnění povinností ukládá. Rozebírány jsou zde i pravomoci jednotlivých správní orgánů. Zároveň je zde řešeno omezování práv...1 Abstract This thesis deals with the legal status of the citizen in the case of defence of the Czech Republic. It summarizes rights and duties of the citizen in this area and seeks to capture possible shortcomings in current legislation. For this purpose, the first chapter focuses on the theoretical state science background of the relationship between the state and the citizen in defence issues. It describes the importance of defence and the reasons why the state should deal with it. Both classical state science theories and contemporary doctrine are used. The second chapter captures the contemporary constitutional position of defence and security issues in general. It describes elementary constitutional principles that determine defence legislation and the citizen's position within. It summarizes the present-day doctrine of limitations placed upon the fundamental rights and freedoms because of defence issues. There are also descriptions of states of crisis with attention to the state of threat to state and state of war, which relate to the defence of the Czech Republic. The third chapter deals with individual defence laws. Attention is paid to the duties and rights that legislation imposes on citizens, the methods by which it does so and the penalties for failure to fulfil these obligations. The powers of...
