Nároky poškozených na náhradu nemajetkové újmy v adhezním řízení Problematika náhrady nemajetkové újmy způsobené trestným činem a její projednání v adhezním řízení se zejména v posledních letech dostává do popředí zájmu jak nejvyšších soudů, tak příslušných odborníků, jejichž názory na jednotlivé otázky se přirozeně rozcházejí. Faktická nemožnost vyčíslení imateriálních újem poškozených osob vyžaduje nezbytnou potřebu existence ustálené rozhodovací praxe nejvyšších soudů a stanovení alespoň základních kritérií, která určují hranice soudcovského uvážení. Snaha posílit postavení poškozených osob je zjevná a jistě vítaná, je třeba však dbát na zachování práva obviněného na obhajobu, jak ve formálním, tak i materiálním smyslu. Tato rigorózní práce je (pomineme-li kapitolu úvodní a závěrečnou) rozčleněna celkem do pěti poměrně rozsáhlých kapitol, kdy každá z nich je věnována jednomu aspektu zkoumané problematiky, včetně návrhu na zdokonalení právní úpravy. První kapitola je věnována obecnému úvodu do problematiky nemajetkových újem a jejich náhrad, základním pojmům adhezního řízení, jeho účelu a smyslu, základním zásadám, jež adhezní řízení ovládají a přirozeně také obecnému účelu trestního řízení jako takového. Kapitola druhá je věnována platné právní úpravě, a to ve třech základních oblastech, jež zkoumanou... Claims of the injured person for compensation for non-material damage in adhesive proceedings In recent years, the issue of compensation for non-material damage caused by a criminal offense and its discussion in adhesive proceedings has come to the forefront of the interest of both the highest courts and relevant experts, whose opinions on individual issues naturally differ. The factual impossibility of quantifying the immaterial damages of injured persons requires the necessary need for the existence of established decision-making practice of the highest courts and the establishment of at least basic criteria that determine the limits of judicial discretion. Efforts to strengthen the position of injured persons are obvious and certainly welcome, but care must be taken to preserve the accused's right to a fair trial, both formally and materially. This rigorous work is (apart from the introductory and concluding chapters) divided into a total of five relatively large chapters, each of which is devoted to one aspect of the researched issues, including a proposal to improve legislation.
