1 ABSTRAKT DISERTAČNÍ PRÁCE Rekognice osob v trestním řízení Disertační práce se podrobně věnuje rekognici osob v trestním řízení, která je nejen tradiční metodou kriminalistické praktické činnosti, ale s účinností od 1. 1. 2002 též samostatným trestněprocesním úkonem upraveným v § 104b tr. řádu jakožto jeden ze zvláštních způsobů dokazování. Současně je třeba reflektovat skutečnost, že kvintesencí rekognice je psychický proces znovupoznávání probíhající na základě komparace dříve vlastními smysly vnímané osoby (zpětně vybavené z paměťové stopy ve formě představy) s osobami aktuálně vnímanými, a to primárně s cílem individuální identifikace neboli ztotožnění. Do celého úkonu, při němž z povahy věci dochází ke střetu práv a zájmů jednotlivých osob, se dále promítá nespočet proměnných jak na straně systému trestní justice (tzv. system variables), tak na straně okolností trestněprávně relevantní události a osob samých (tzv. estimator variables). Mnohé z proměnných přitom nelze objektivně postihnout. Zahraniční zpětné prověrky pravomocně rozhodnutých případů navíc jednoznačně prokazují značnou chybovost očitých svědectví, jež implikuje vysoké riziko usvědčení fakticky nevinných osob, dostanou-li se tyto do hledáčku orgánů činných v trestním řízení jakožto možní pachatelé. Rekognici pro vše uvedené pojímáme jako... 1 ABSTRACT DISSERTATION Human Line-up in Criminal Proceedings The thesis deals in detail with the human line-up in criminal proceedings, which is not only a traditional method of practical activity of police investigators, but with effect from 1st January 2002 also a separate criminal procedural step regulated in § 104b of the Penal Procedure Code as one of the special means of the taking of evidence. At the same time, it is necessary to reflect the fact that the quintessence of line-up is a psychological process of reconnaissance based on a comparison of a previously perceived person (retroactively equipped from a memory trace in the form of an idea/image) with currently perceived persons. The purpose of this procedure is primarily individual identification. The whole act, in which the rights and interests of individuals are logically in conflict, also reflects a large number of variables both on the part of the system of criminal justice (system variables) and on the side of circumstances of the criminally relevant event and of the persons themselves (estimator variables). Many of the variables cannot be objectively assessed.
