1 Zánik služebního poměru vojáka z povolání s akcentem na porovnání se skončením pracovního poměru Abstrakt Předkládaná práce je věnována otázce zániku služebního poměru vojáka z povolání podle zákona o vojácích z povolání v porovnání s právní úpravou skončení pracovního poměru zaměstnance podle zákoníku práce. Za tím účelem je popsána aktuální právní úprava zániku služebního poměru a jsou vyzdviženy odlišnosti od právní úpravy skončení pracovního poměru. Současně byla posouzena jak práva spojená se zánikem služebního poměru, tak i následky případného zrušení rozhodnutí o zániku služebního poměru. Výsledkem zkoumání bylo zjištění významné podobnosti obou právních úprav, ale také konkrétních odlišností. Podobnost je možno spatřovat v případě vybraných způsobů zániku (resp. skončení) obou poměrů - uplynutím doby, úmrtím vojáka či zaměstnance či zrušením poměru ve zkušební době. Oba poměry se pak liší v případě práva na výsluhové náležitosti, které ze zákona náleží vojákům z povolání při splnění stanovených podmínek, zatímco zaměstnancům v pracovním poměru zákon nic podobného nepřiznává. Aktuální právní úprava byla také hodnocena s ohledem na možnost úpravy de lege ferenda. Při té příležitosti byla zjištěna potřeba přijetí dílčích změn menšího i většího významu. Mezi první z nich by bylo možno zařadit vhodnost... 1 Termination of military service of a professional soldier with an emphasis on comparison with the termination of employment Abstract This thesis is devoted to the topic of the termination of military service of a professional soldier according to the law on professional soldiers in comparison to legal frame of termination of emplyoment according to the labour code. In regard to achieve that goal, a current legal regulation of termination of military service is described and differences from the legal regulation of termination of employment are highlighted. Concurrently, both the rights associated with the termination of military service and the consequences of the possible annulment of the decision on termination of military service were assessed. The result of the examination was to find out the significant similarity of both legal regulations, but also specific differences. The similarity can be seen in the case of selected ways of termination of both relationships (military service and employment) - the expiration of time, the death of a soldier or employee or the cancellation of the relationship during the trial period.
