Trestněprávní postih podvodných jednání s peněžními prostředky Evropské unie Daniella Sarah Sotolářová Abstrakt Postupující integrace Evropské unie - a s ní spojené rozšiřování pravomocí jejích orgánů a užší spolupráce členských států v řadě oblastí - s sebou nese různé nové výzvy a staví řadu subjektů před řešení dosud nezodpovězených otázek. To platí i o trestněprávní oblasti a o subjektech činných v trestních věcech. V posledním období bylo na úrovni Evropské unie dosaženo zásadního pokroku na cestě k harmonizaci určitých trestněprávních norem a byly podniknuty zásadní kroky vedoucí k reformě soustavy institucí a orgánů aktivních v trestních věcech, v nichž jde o trestněprávně postižitelná porušení těchto norem. Nejdále se tyto harmonizační a reformní kroky dostaly v oblasti trestněprávní ochrany finančních zájmů Evropské unie před jednáními podvodné povahy. Ne všechno však bylo v daném překotném vývoji dotaženo. Otevřené - a nedefinované - zůstalo už to co vůbec patří do oněch chráněných finančních zájmů Evropské unie. Její normotvorba přišla s pojetím trestněprávně postižitelných jednání podvodné povahy zásadně překračujícím rámec toho co je běžně v právní teorii i praxi považováno za charakteristické pro činy dané povahy a vyšetřování těchto činů svěřila prvnímu nadnárodnímu justičnímu orgánu činnému... Daniella Sarah Sotolářová Summary The ongoing integration of the European Union - and the related extension of the powers of its bodies and closer cooperation between the Member States in many areas - brings about various new challenges and urges many subjects to deal with issues yet unresolved. This also applies to the field of criminal law and to the subjects active in criminal matters. A substantial progress has been made recently at the European Union level on the way towards the harmonization of certain criminal law standards and major steps have been taken leading to the reform of the system of the institutions and bodies active in criminal matters which include criminal offences against these standards. These harmonization and reform steps have reached furthest in the area of criminal law protection of the financial interests of the European Union against acts of a fraudulent nature. However, not everything has been achieved completely in the rapid development. It still remains open - and undefined - what really belongs among those protected financial interests of the European Union.
