Název diplomové práce, abstrakt a klíčová slova v českém jazyce Název Ústavněprávní regulace výjimečného stavu v právním státě Abstrakt Předložená práce se zaměřuje na mimořádné reaktivní právní instrumenty určené k řešení krizí, mezi něž řadíme zejména výjimečný stav a rovněž právo na odpor, které se od prvního z uvedených institutů liší v tom ohledu, že se jej v podmínkách demokratického právního státu nemohou dovolat orgány veřejné moci, nýbrž pouze občané coby subjekty podřízené její autoritě. K hlavním cílům práce patří rigorózně prozkoumat pojmy výjimečného stavu a práva na odpor a jejich vztah a podat odpověď na otázku, zda mají být jimi označené instituty v podmínkách právního státu regulovány v pozitivním právu nebo jinak uznány. V kapitole věnované výjimečnému stavu zkoumáme pojmy krize a výjimečného stavu, prezentujeme různé typologie tohoto institutu, ukazujeme kontroverze, konfuze a problémy, které jsou s ním spojeny, představujeme možné reakce veřejné moci na mimořádné škodlivé situace a posuzujeme jejich přednosti a nedostatky. V návaznosti na závěr, že výjimečný stav by měl být upraven v pozitivním právu, následně věnujeme pozornost otázce, jakým způsobem a v souladu s jakými zásadami by do něj měl být inkorporován. Název diplomové práce, abstrakt a klíčová slova v anglickém jazyce Title Constitutional Regulation of the State of Exception in a Rechtsstaat Abstract This treatise focuses on extraordinary reactive legal instruments designed for crises resolution, which include in particular the state of exception and also the right to resistance. The latter differs from the former in that it cannot be invoked by public authorities under a Rechtsstaat, but only by citizens who are subject to their authority. The aim of this treatise is to thoroughly examine the concepts of the state of exception and the right to resistance and their relation and to answer the question of whether the corresponding institutions should be regulated in positive law or otherwise recognized under a Rechtsstaat. In the chapter on the state of exception, I inquire into the concepts of crisis and state of exception, present various typologies of this institution, outline controversies, confusions and problems associated with it, present possible responses of public authorities to exceptional harmful situations and assess their advantages and drawbacks.
