Název práce: Neodkladné a neopakovatelné úkony v přípravném řízení Abstrakt Neodkladné a neopakovatelné úkony jsou neodmyslitelnou součástí trestního řízení a jen těžko by bez nich orgány činné v trestním řízení, byli schopni odhalovat pachatele trestních činů. I přes jejich vlastnost, popírat základní lidské práva je jejich provádění v některých případech nezbytně nutné pro zjišťování materiální pravdy. Tento rozpor, kde na jedné straně stojí snaha státu o zachování bezpečnosti a na straně druhé, právo jednotlivce na zachování práva na spravedlivý proces, představuje pro celé trestní řízení nebezpečí možného pochybení. Cílem této práce bylo poukázat na to, že jejich provádění má nemalý vliv na celkový výsledek trestního řízení. Tento spočívá v jejich měnící se důkazní síle, příp. až v jejich absolutní neúčinnosti. Jednotlivé úkony byly do trestního řádu začleňovány postupně, z nejobecnějších zákonných mantinelů až do dnešní podoby. Ani dnes však nemůže s jistotou říct, že jejich zákonná úprava odpovídá aktuálním potřebám. Z analýzy judikatury jednotlivých neodkladných a /nebo neopakovatelných úkonů vyplývá, že jejich dotváření soudy je nezbytné. Z dostupné analýzy bylo zjištěno, že na důkazní hodnotu mají vliv následující faktory: (i) nedostatečné odůvodnění neodkladnosti nebo neopakovatelnosti, ale též... 1 Abstract Urgent and unrepeatable acts are an integral part of criminal proceedings and it would be difficult for law enforcement authorities to detect perpetrators of criminal offenses without them. Despite their characteristic of denying fundamental human rights, their implementation is in some cases essential for finding the material truth. This contradiction between the state's effort to maintain security on the one hand and the individual's right to a fair trial on the other poses a risk of possible misconduct for the entire criminal proceedings. The aim of this work was to point out that their implementation has a significant impact on the overall outcome of criminal proceedings considering their changing probative value, or even their absolute ineffectiveness. The individual acts were gradually incorporated into the Criminal Procedure Code from the most general legal boundaries to their present form. However, even today, it cannot be said with certainty that their legal regulation corresponds to the current needs. An analysis of the case law of individual urgent and / or unrepeatable acts shows that their completion by courts is necessary.
