[cze][eng] Ochrana životního prostředí ve vybraných řízeních podle stavebního zákona Nekontrolovaná stavební činnost může poškodit přírodní zdroje, ekosystémy i jednotlivé složky životního prostředí nezvratným či obtížně napravitelným způsobem, a tím znemožnit další vývoj či dokonce přežití obyvatel planety. V českých podmínkách přispívá k ochraně životního prostředí především regulatorní činnost správních orgánů, a to za účasti subjektů dotčených určitým stavebním záměrem. Tato disertační práce se proto zabývá metodami, způsoby, instituty a nástroji ochrany životního prostředí v rámci vybraných řízení usměrňujících výstavbu. Konkrétně je cílem práce zhodnotit možnosti uplatnění environmentální ochrany v rámci realizačně-povolovacích postupů zakotvených v ustanoveních § 103 až § 117 stavebního zákona. Samostatně je zkoumán každý z pěti stavebně-procedurálních režimů, jejichž užití předznamenává potencialitu konkrétní stavební záměr provést, tedy režim stavebního řízení, ohlášení, veřejnoprávní smlouvy, oznámení s certifikátem autorizovaného inspektora a záměrů nevyžadujících stavební povolení ani ohlášení. Proces povolování staveb významně ovlivňuje řada faktorů, které brání efektivnímu posuzování konkrétních stavebních záměrů z hlediska jejich environmentálních dopadů. In the Czech legal system, the regulatory measures of administrative bodies, along with the participation of the affected stakeholders, contribute to the environmental protection of the individual development project. This dissertation examines the methods, means, and tools of environmental protection within the framework of designated proceedings regulating the construction. Specifically, it analyzes the possibilities of implementing protective environmental measures within the construction-permitting procedures enshrined in the provisions of Sections 103 to 117 of the Building Act. Five construction-permitting regimes are examined separately: the building permit process; notification; public law contract; notification with certificate of the authorized inspector and projects requiring neither building permit nor notification.
