Dotační podvod a poškození finančních zájmů Evropské unie Abstrakt Práce se zabývá zejména definicí a postihem trestného činu dotačního podvodu v rámci trestního práva. Současně se zaměřuje i na některé otázky související s touto trestnou činností, a to zejména subsidiaritu trestního postihu a souběh tohoto trestného činu s dalšími trestnými činy jako je trestný čin poškození finančních zájmů EU. Metodou zpracování je především dedukce a analýza, v příslušných částech pak indukce, syntéza a komparace. Práci je rozdělena do tří hlavních částí. Nejprve se věnuje dotacím a dotačnímu podvodu, kdy vysvětluje, co to je dotace a jaké jednání lze považovat za dotační podvod, a dále ozřejmuje některé instituty spojené s těmito pojmy, mj. rozpočtová pravidla, zdroje, evidenci. Zabývá se rovněž tím, jaká jednání jsou spojena s trestným činem dotačního podvodu. U trestného činu dotačního podvodu se tedy zabývá jeho znaky, vztahem k jiným ustanovením trestního zákoníku, vyšetřováním a ukládáním trestu. V další části se práce věnuje ochraně finančních zájmů Evropské unie, především pak instititucím a orgánům, jež mají zvláště za cíl ochranu těchto zájmů, jako jsou Eurojust, OLAF, NCOZ a více pozornosti je pak věnováno novému institutu, jímž je Úřad evropského prokurátora. Dále rozebírá skutkovou podstatu trestného činu... 1 Subsidy fraud and damaging the financial interests of the European union Abstract The thesis deals mainly with the definition and punishment of subsidy frauds within the framework of criminal law. At the same time, it also addresses some issues related to this crime, in particular the subsidiarity of criminal sanctions and the concurrence of this crime with other crimes such as the offense of damaging the financial intereststhe of the European union. The method of processing is mainly deduction and analysis, in the relevant parts induction, synthesis and comparison. The thesis is divided into three main parts. First, it deals with subsidies and subsidy fraud, explaining what a subsidy is and what action can be considered a subsidy fraud, and also clarifies some of the institutes associated with these terms, including budget rules, resources, and records. It also deals with what actions are associated with the crime of subsidy fraud. Thus, in the case of a subsidy fraud, it deals with its characteristics, its relation to other provisions of the Penal Code, the investigation and the imposition of punishment.
