Tato práce se věnuje právním poměrům plynoucím z neoprávněných staveb v rovině soukromého práva. S ohledem na zásadní změny, které do soukromého práva přinesl zákon č. 89/2012 Sb., občanský zákoník (ObčZ), pak autorka podrobuje kritickému pohledu dosavadní judikaturu i současnou doktrínu a názory v literatuře a s přihlédnutím k německé soudní praxi a literatuře hledá vhodná výkladová vodítka, která jsou aplikovatelná na současnou právní úpravu. Autorka rovněž využívá závěrů vztahujícím se k ObčZ 1964 a především k obecnému zákoníku občanskému (ABGB), který na území České republiky rovněž platil a který je velkým inspiračním zdrojem současné zákonné úpravy. Na úvod v kapitole 1 navazuje hlavní stať. Ložiskem práce jsou její kapitoly 2 a 3, které obsahují zhodnocení aktuální právní úpravy ve světle dostupné literatury a judikatury. Kapitola 2 hodnotí českou právní úpravu po rekodifikaci, přičemž kriticky nazírá na starší judikaturu a doposud dostupnou literaturu a vyvozuje z ní závěry aplikovatelné na současnou legislativní situaci v České republice. Kapitola 3 se pak věnuje německé právní úpravě, poukazuje na její rozdílnosti oproti vnímání neoprávněné stavby v českém právním systému, přičemž na základě tohoto srovnání se autorka snaží vyvozovat další argumentaci vztahující se k české právní úpravě... This thesis deals with legal relations arising from illegal structures at the level of private law. In view of the fundamental changes brought to private law by Act No. 89/2012 Coll., the Civil Code, the author submits a critical view of the existing jurisprudence and current doctrines and opinions in literature, and, looking for German judicial practice and literature, seeks appropriate interpretative instructions, which are applicable to current legislation. The author also uses conclusions relating to the 1964 Civil Code and, in particular, to General Civil Code (ABGB), which are also applied in the Czech Republic and which is a great source of inspiration for the current legal regulation. The main chapter begins after the introduction in Chapter 1. The focus of this work lies in Chapters 2 and 3, which contain an assessment of the current legislation in light of the available literature and jurisprudence. Chapter 2 evaluates the Czech legal regulation after recodification, criticizing older case law and literature available so far and drawing conclusions from it which are applicable to the current legislative situation in the Czech Republic.
