Cílem diplomové práce je přiblížit a rozebrat samostatně jednotlivé předpoklady pro vznik povinnosti k náhradě újmy podle úpravy v OZ. Důraz je přitom kladen zejména na ublížení na zdraví a na nároky s ním spojené, tedy náhradu bolesti a náhradu za ztížení společenského uplatnění. Podstatná část je věnována způsobu a výši odškodnění, zejména s ohledem na přijetí nové koncepce, kdy odškodňována má být újma v plné výši podle zásad slušnosti, pokud ji nelze určit jinak. Vedle toho bylo nutné se v práci vypořádat i s dalšími nemajetkovými újmami, pod které se řadí především způsobené duševní útrapy. Vyjma úvodu a závěru (první a pátá kapitola) se práce skládá ze tří hlavních kapitol. Druhá kapitola se věnuje vztahu dvou zdánlivě samostatně existujících fenoménů dnešní doby, a to právu a sportu. Nejprve je vymezen pojem sportu pomocí jeho charakteristických znaků, na což navazuje samotný vztah práva a sportu. Dále se práce věnuje problematické existenci právního odvětví sportovního práva. Třetí kapitola referuje o institutu právní odpovědnosti v rámci právního řádu České republiky, nejprve v obecné rovině, následně s upřesněním na odpovědnost podle soukromého práva, přesněji řečeno odpovědnost podle OZ. Vedle toho jsou zároveň v rámci jedné z podkapitol zmíněny hlavní rysy právní úpravy účinné před 1.... The purpose of thesis is to independently describe and analyze various assumptions upon which arises the liability to damages according to regulation in OZ. The emphasis is being placed particularly on damage to health and associated claims, i.e. compensation for pain and social impairment. A substantial part is devoted to the method and amount of compensation, particularly with regard to the adoption of a new concept, which is to be indemnified loss in full accordance to the principles of decency, if case it cannot be determined otherwise. In addition, it was necessary to deal with other non-pecuniary injuries which include injuries caused by mental distress. The thesis is, besides introduction and conclusion (the first and fifth chapter), composed of three main chapters. The second chapter is devoted to the relationship between two seemingly independently existing phenomena of recent time, and those are law and sport. First, it defines the concept of sport through its characteristics, which is followed by the actual relationship between law and sport. Further, the thesis describes a problematic existence of the branch of Sports law.
