142 Abstrakt Tato diplomová práce je věnována civilnímu letectví v Evropě a specificky právní úpravě poskytování letových navigačních služeb a uspořádání letového provozu. Cílem práce je analyzovat vývoj legislativní reformy letových navigačních služeb a systému uspořádání letového provozu v Evropě se zaměřením na vliv unijního práva prostřednictvím iniciativy Jednotného evropského nebe, rozebrat hlavní prvky modernizačního úsilí a poukázat na proměny postavení a vztahů zúčastněných stran v důsledku nového právního a institucionálního rámce. První kapitola představuje princip státní suverenity nad vzdušným prostorem, jenž tvoří základ leteckého práva. Druhá kapitola se věnuje letovým navigačním službám a právní úpravě jejich poskytování podle Úmluvy o mezinárodním civilním letectví. Následující kapitola uvádí přehled hlavních organizací zúčastněných na civilním letectví se zaměřením na ICAO, EUROCONTROL a Evropskou unii, její postavení, systematiku práva Evropské unie a na Evropskou agenturu pro bezpečnost letectví. Čtvrtá kapitola se zaměřuje na společnou dopravní politiku EU v oblasti letecké dopravy, postupnou liberalizaci letecké dopravy, včetně jejích důsledků, a aktuální směry politiky EU v oblasti letectví. Pátá kapitola tvoří stěžejní část práce, rozebírá do detailu jednotlivé balíčky opatření... 143 Abstract The present diploma thesis is dedicated to European civil aviation and in particular to the regulation of provision of air navigation services and air traffic management. The purpose of the thesis is to analyse the evolution of the legislative reform of air navigation services and air traffic management in Europe with a focus on the influence of European Union law through the initiative "Single European Sky". Next, the thesis aims to study the main elements of the modernisation efforts and to point at the transformation of the situation and relationships between the relevant stakeholders as results from the new form of the regulatory and institutional framework. First chapter presents the principle of state sovereignty over the airspace which constitutes the fundamental principle of aviation law. Second chapter treats air navigation services and the legal regulation of their provision according to the Convention on International Civil Aviation. The following chapter introduces the summary of main organisations involved in civil aviation focussing on ICAO, EUROCONTROL, European Union, its status, the systematics of EU law and on the European Aviation Safety Agency.
