Práce komplexně popisuje právní úpravu přechodu dluhů a pohledávek ze zůstavitele na dědice v účinné právní úpravě nového občanského zákoníku a dále porovnává úpravu odpovědnosti za dluhy zůstavitele a souvisejících institutů v České republice s právními řády dalších tří států. Práce je rozdělena na patnáct kapitol. Nejprve se zaměřuje na princip univerzální sukcese, výjimky z něj a dále na přechod práv a povinností na základě zvláštních režimů právního nástupnictví. V další kapitole je popsána úprava odpovědnosti dědiců za dluhy zůstavitele a souvisejících institutů v předpisech, které předcházely účinné právní úpravě, což je doplněno četnými vzájemnými komparacemi mezi přepisy a poukázáním na inspiraci nového občanského zákoníku v obecném zákoníku občanském z roku 1811. Těžiště práce tvoří nejobsáhlejší kapitola čtvrtá, kde je komplexně vysvětlena úprava odpovědnosti za dluhy zůstavitele v novém občanském zákoníku a zejména objasněn z více hledisek institut výhrady soupisu a možnost neomezené odpovědnosti dědiců. Dále jsou v práci popsány instituty odmítnutí, vzdání se a zřeknutí se dědictví. Velmi důležitá je kapitola šestá, věnující se odkazu jako staronovému institutu dědického práva, na základě něhož dochází k singulární sukcesi. The thesis deals with the topic of debst and claims of the testator and legal regulation of responsibility of heirs for debts of the testator in the Czech legal system and compares it with legal regulation in other three european countries. Second chapter is focused on the principle of universal succession and exceptions from the priciple. Third chapter includes historical developement of regulation of responsibility for debts and related instruments. Fourth chapter thoroughly explains and analyzes the instrument of the inventory clause and deals with posibility of unlimited responsibility of heirs, which both were not contained in Civil code from 1964, but new czech civil code now include them. Fifth chapter focuses on three instruments - refusal, give up and renunciation of succession claim. Important is also sixth chapter which shifts the focus on bequest (legacy). It explains this restored instrument which forms the singular succession with no responsibility for debts. Then it analyzes the legal position of legatee as a creditor and describes distinction between heirs and legatees.
