V rigorózní práci se věnuji problematice ochrany osobnosti pacienta v kontextu poskytování zdravotních služeb. Jedná se o oblast, v níž v posledních několika letech došlo k významným změnám. V roce 2001 byla přijata Úmluva o lidských právech a biomedicíně. V roce 2012 nabyl účinnosti zákon o zdravotních službách, který je stěžejním právním předpisem obsahujícím úpravu poskytování zdravotních služeb. O dva roky později pak nabyl účinnosti občanský zákoník, který těž poměrně komplexně upravuje oblast poskytování zdravotních služeb, čímž vytváří prostředí, kdy některé aspekty poskytování zdravotních služeb jsou upraveny duplicitně, ve dvou paralelních úpravách, a je tudíž nutné zabývat se otázkou vztahu mezi nimi. Cílem rigorózní práce je vytvořit komplexní přehled současné právní úpravy osobnostních práv pacientů v kontextu poskytování zdravotních služeb. Pokouším se o kritickou analýzu relevantních ustanovení zejména občanského zákoníku a zákona o zdravotních službách a snažím se upozornit na problematické aspekty vycházející nejen ze vztahu mezi občanským zákoníkem a zákonem o zdravotních službách, ale i z právní úpravy občanského zákoníku samotné. Upozorňuji na ustanovení, která považuji za nekoncepční nebo terminologicky nesprávné, v některých částech se tuto nekoncepčnost pokouším demonstrovat... The thesis focuses on the issue of protection of personality rights of patients in the context of medical care provision. Regulation of personality rights protection represents an area of law where significant changes were made in the past. The aim of the thesis is to provide a complex overview of the law regulating personality rights of patients in the context of medical care provision, to analyse critically the relevant sections of the Civil Code and the Act on Health Services and Conditions of Their Provision and to point out problematic aspects of the current regulation, with particular focus on the relation between the two acts. I also highlight the lack of concept in some parts of the Civil Code, which I attempt to demonstrate on simple practical examples. Protection of personality rights of patients in the context of medical care provision is undoubtedly a very actual topic. The paternalistic model of doctor-patient relationship has been replaced by present-day contractual model where the patient acts as an active participant in the process of decision making. The regulation of the Civil Code supports this approach and emphasises the importance of an existence of effective means of protection.
