Resumé Právní institut promlčení je součástí právních systémů již od dob římského práva, přesto se nejedná o právní relikt, který by v moderní pojetí práva neměl své místo. Promlčení je právním institutem, jenž je nedílnou součástí moderních právních řádů a jehož význam v právu je ověřen tradicí čítající více jak patnáct set let. Cílem této diplomové práce je podat komplexní výklad o institutu promlčení v oblasti občanského práva. Tato závěrečná práce v pěti kapitolách přibližuje postavení promlčení mezi ostatními právními skutečnostmi, podrobuje ho důkladné analýze, poskytuje vhled do úpravy promlčení de lege lata i její evoluci na našem území v historických civilněprávních kodifikacích a komparuje ji s pojetími vybraných evropských zemí. První kapitola pojednává obecně o právních skutečnostech, tyto skutečnosti dělí podle tradičního klíče a na základě tohoto dělení mezi ně řadí institut promlčení. Druhá kapitola definuje pojem promlčení, poukazuje na jeho smysl, analyzuje jeho dílčí složky, podrobuje námitku promlčení testu souladu s dobrými mravy, vypočítává práva, která promlčení podléhají, a uvádí, která jsou naopak zákonodárcem prohlášena za nepromlčitelná. V této kapitole jsou taktéž nastíněny odlišné názory soudní praxe na uplatnění námitky promlčení v odvolacím řízení. Třetí kapitola je věnována... Limitation as a legal fact Legal institute of limitation has been a part of the legal system since the days of Roman law, yet it is not a legal relic, which in the modern concept of rights had their place. Limitation is a legal institute that is an integral part of modern legislation and whose meaning in law is a proven tradition of more than fifteen hundred years. The aim of this thesis is to give a comprehensive explanation about the institute of limitation in civil law. This thesis divided into five chapters approaches the status of limitation among other legal facts, subjecting it to a thorough analysis, gives the view on the concept of limitation de lege lata and its evolution in our country through historic civil law codification and compares its approach with adjustments in selected European countries. The first chapter discusses general information about legal facts which are divided by traditional keys and on the basis of this division and between them rest the institute of limitation. The second chapter defines the concept of limitation, refers to its meaning, analyzes its components, tests subjects objection of forfeiture accordance with good manners, calculates the rights that are subject to limitation and states that are contrary legislature declared inviolable.
