Tato rigorózní práce popisuje dvě témata. V prvním, obsáhlejším a esenciálním tématu se autor soustřeďuje na bytové spoluvlastnictví. V komparaci s předchozím zákonem přinesl nový kodex určitý posun v chápání komplexního institutu. V novém občanském kodexu se již nemluví o vlastnictví bytů, nýbrž o bytovém spoluvlastnictví, díky čemuž, mimo uspokojení bytových potřeb, uděluje silnější vehemenci na spoluvlastnictví budovy. Část této práce je věnována přídatnému spoluvlastnictví, z důvodu, že se jedná o zvláštní úpravu spoluvlastnictví, jež má za úkol navést vlastníka nemovitostí k méně složitější správě kolektivních věcí. Závěrečná kapitola se zaměřuje na judikaturu, aby měl čtenář pokud možno co nejvíce komplexní obraz o dané problematice. This thesis analyzes two issues. In the first, more extensive and more significant issue the author focuses on residency co-ownership in new Civil Code. In comparison with previous legislation, the new one brings slight shift in understanding of this comprehensive legal institute. New Civil Code uses term residency co-ownership instead of flat ownership, thus, apart from securing housing needs, emphasizing house co-ownership. Part of this thesis is dedicated to accessory co-ownership, as special co-ownership legislation, with goal of simplifying common ownership management. Last chapter is dedicated to judicial decisions, enabling reader to gain overview of this topic.
