Rigorózní práce na téma Ochrana ozonové vrstvy a klimatu v mezinárodním právu je zaměřena na dvě významné oblasti ochrany atmosféry v rámci mezinárodního práva životního prostředí. V rámci rozboru obou mezinárodněprávních systémů obsahuje jak rozbor historického vývoje jednotlivých právních úprav, tak popis jejich současné podoby se zaměřením na nejvýznamnější mezinárodní smlouvy a povinnosti smluvních stran v nich obsažené. Cílem práce je srovnání obou mezinárodněprávních úprav a následná interpretace výsledků tohoto srovnání ve světle nejrůznějších faktorů, které měly na podobu právní úpravy vliv. S přihlédnutím k aktuálnímu vývoji v oblasti mezinárodněprávní ochrany klimatu je podobný rozbor silných a slabých stránek právní úpravy zcela klíčový pro vytváření nové právní úpravy. Srovnání s dalším příbuzným mezinárodněprávním systémem pak může poskytnout cenné informace jak pro volbu jednotlivých právních nástrojů použitých v nově vznikající právní úpravě, tak pro vyhodnocování jejich možného vlivu na chování budoucích smluvních stran. The thesis aimed at Protection of ozone layer and climate under international law is focused on the two important areas of atmosphere protection under international environmental law. It analyzes the international legal systems both from the point of view of historical development of the legal system and their current states, with emphasis on the most important international treaties and obligations of its parties. The purpose of the thesis is to compare both international legal systems and to interpret the results of the comparison with use of various factors which have influenced the state of the legislation. The contemporary evolution of international climatic protection demands an analysis of strengths and weaknesses of current legislation for the purpose of creating the new international treaty. A comparison with another similar international legal system can provide valuable information for the choice of legal tools for the future legislation as well as for evaluation of its possible influence on behaviour of the future parties.
