Tato rigorózní práce podrobně rozebírá právní úpravu týkající se územní ochrany přírody a krajiny a to z evropského i českého pohledu. Práce se nejdříve zabývá evropskými prameny ochrany přírody a krajiny z toho nejobecnějšího pohledu, tedy vybranými ustanoveními Smlouvy o fungování Evropské unie a Akčními programy EU, včetně nové strategie EU v oblasti biodiverzity do roku 2020. Následně pak přechází k historickému vývoji v českých zemích až do současnosti. Ze současné problematiky řeší obecnou a zvláštní územní ochranu v českém právním řádu, upravenou v zákoně č. 114/1992 Sb. a rozebírá její jednotlivé právní nástroje ochrany. Práce pak podrobně popisuje evropské právo (směrnice 92/42/EHS o stanovištích a směrnice 2009/149/ES o ptácích), včetně judikátů Soudního dvora Evropské unie, i české právní prameny týkající se soustavy Natura 2000 a zároveň hodnotí úspěšnost transpozice a implementace uvedených směrnic do českého právního řádu. Na závěr je pomocí srovnávací metody porovnána česká právní úprava týkající se Natury 2000 a zvláštní územní ochrany a vyzdviženy rozdíly mezi nimi. Práce se zabývá rovněž právní odpovědností v ochraně přírody a krajiny a organizační strukturou orgánů ochrany přírody, což jsou témata blízce související se zaměřením práce. This rigorous thesis analyzes in detail the legislation relating to the territorial nature and landscape protection and that of the European and Czech perspective. The thesis describes the legal sources of European nature and landscape protection from the most general point of view, with focus on certain articles of the Treaty on the Functioning of the European Union and EU Action Programs, including the new EU Biodiversity Strategy to 2020. The thesis also refers to the historical development of nature and landscape protection in the Czech lands to the present. It also describes general and special territorial protection in the Czech legal system, included especially in Act No. 114/1992 Coll and analyzes various legal instruments of nature and landscape protection. The thesis describes the European law (Habitats Directive 92/42/EEC and Birds Directive 2009/147/EC, also judgments of the European Court of Justice) and Czech legal sources concerning the Natura 2000 network, and evaluates the success of the transposition and implementation of the Directives in Czech law. In conclusion of the thesis there is used the comparative method to compare Czech legislation relating to Natura 2000 with the special territorial protection and author highlights the differences between them.
