128 Abstrakt v českém jazyce Koordinací systémů sociálního zabezpečení rozumíme vzájemné propojení sociálních systémů členských zemí tak, aby byl uskutečněn volný pohyb osob v rámci EU. Cílem aplikace koordinačních nařízení je zajištění, aby migrující osoba neztratila své nároky na sociální dávky jen proto, že využila svého práva na volný pohyb. Vzhledem k rozsáhlosti této problematiky je však práce zaměřena pouze na oblast starobních a pozůstalostních důchodů podle platných nařízení Evropského parlamentu a Rady (ES) č. 883/2004 a č. 987/2009, účinných od 1. května 2010. Úvodní z pěti kapitol práce se obecně zaměřuje na charakter koordinačních nařízení a objasňuje jejich vývoj a účel. Dále seznamuje čtenáře s dalšími prameny koordinačního práva a navíc vyjasňuje jejich vztah k dalším pramenům unijního i mezinárodního práva. Nezbytnou součástí je vymezení osobní a věcné působnosti koordinačních nařízení. Druhá kapitola vyzdvihuje význam základních principů koordinačních nařízení - princip rovného zacházení, princip použití jednoho právního řádu, princip sčítání dob pojištění, princip exportu dávek, princip stejného posuzování skutečností a princip dobré spolupráce mezi orgány zabezpečující koordinaci systémů sociálního zabezpečení. Aplikací těchto fundamentálních zásad je zajištěno, že migrující osobě jsou... 130 Abstrakt v anglickém jazyce We comprehend the coordination of social security systems as an interconnection of social security systems of Member States therefore the free movement of persons can be carried out. The aim of Coordinating Regulations is to ensure that a migrant does not loose his/her claims on social rights due to his/her enjoyment of free movement. Concerning the large extent of this topic the thesis is focusing only on old-age and survivors' pensions according to valid Regulations (EC) No 883/2004 and No 987/2009 of the European Parliament and of the Council which entered into force on 1 May 2010. The preliminary chapter out of five at total generally presents the nature of the Coordinating Regulations. It clears up their development and aims. It further introduces other sources of coordination law and explains their relations with other sources of EU law and international law. The determination of personal and material scope of Coordinating Regulations is the indispensable part of this chapter as well.
