Tato doktorská disertační práce pojednává o vybraných aspektech svobody náboženství v Evropě. Jejím cílem je představit právní rámec, ve kterém se náboženská svoboda vysky- tuje, a zasadit tuto d·ležitou svobodu do širšího kulturního, náboženského a lidskopráv- ního kontextu. D·sledná kontextualizace, zd·razňovaná v pr·běhu celé práce, vychází z předpokladu, že není možné vyextrahovat čistě právní koncept náboženské svobody, který by nebyl ovlivněn společenskými, právními, kulturními a náboženskými kontexty jeho au- tor·; ve skutečnosti je chápání náboženské svobody každého člověka zakořeněno v jeho kultuře, náboženství a životní zkušenosti. Tento závěr by však neměl vést k naprostému skepticismu ohledně porozumění nábožen- ské svobodě a ohledně možnosti její celosvětové ochrany. Právě naopak, měl by motivovat každého interpreta a zákonodárce v oblasti náboženské svobody ke studiu rozličných po- rozumění všech osob dotčených v konkrétním případě nebo v určité situaci. Po d·kladném studiu všech nárok· vycházejících z náboženské svobody a po zohlednění všech dalších práv, princip· a zájm· vyskytujících se v daném případu či situaci, by mělo být podstatně jednoduší činit spravedlivější rozhodnutí, než by tomu bylo bez zohlednění zmíněných po- rozumění a kontext·. Freedom of Religion or Belief in the Context of European and International Law This PhD dissertation focuses on selected aspects of freedom of religion or belief in Europe. It aims to introduce the legal framework in which religious freedom has to operate, and to place this essential freedom into a broader cultural, religious and human rights context. The contextualisation emphasised throughout this dissertation is based on an assumption that it is not possible to establish a pure legal notion of religious freedom that would not bear any imprint of the societal, legal, cultural and religious context of its authors; in reality, each person's understanding of religious freedom is rooted in his culture, religion and experience. This should not lead, however, to a complete rejection of the possibility of a common understanding and universal protection of religious freedom. On the contrary, it should motivate each interpreter and law-maker in the area of religious freedom to study the understandings of all persons and entities involved in a particular case or situation.
