[cze][eng] Závěr Z biologického hlediska je zvíře živočichem, jeho definice je v biologii tedy zcela jasná a nečiní žádné interpretační potíže. Naproti tomu v právu se mezi pojmy zvíře a živočich nečiní rovnítko a je proto nezbytné oba tyto pojmy vyložit. Pojem zvíře vymezuje zákon č. 246/1992 Sb., na ochranu zvířat proti týrání, který za zvíře považuje každého živého obratlovce, kromě člověka. Není jím však plod či embryo. Omezení pojmu zvíře pouze na obratlovce stvrzuje, že pojem volně žijící živočich, kterým je jedinec živočišného druhu, jehož populace se udržují v přírodě samovolně, a to včetně jedince odchovaného v lidské péči vypuštěného v souladu s právními předpisy, je pojmem značně širším. Volně žijícím živočichem se podle zákona č. 114/1992 Sb., o ochraně přírody a krajiny rozumí také všechna vývojová stádia daného jedince. Jedinec zdivočelé populace domestikovaného druhu se za volně žijícího živočicha nepovažuje. Novelizované znění (novela č. 349/2009 Sb.,) § 3 odst. 1 písm. d) ZOPŘK vyřešilo problém s dlouho kritizovaným předchozím zněním pojmu volně žijícího živočicha, jenž bylo v rozporu se samotným smyslem ZOPŘK a také s požadavky směrnice o ochraně volně žijících ptáků. Současnou definici volně žijícího živočicha, obsaženou v ZOPŘK lze považovat za zcela korektní a poskytující náležitou ochranu. Pojem...This Dissertation - "Legal dispositions relative to the protection of animals" - analyses the legal protection of animals both in the Czech Republic and in Italy. The principal aim of this dissertation is to provide a comparison between Czech legislation and Italian legislation regarding that matter. The first chapter defines the concept of animal, both in the biological sense and legal sense. This chapter also treats of animals' status in private law and in public law. The Czech Civil Code (n.40/1964) defines the legal status of an animal as being a "thing", with the difference, however that animals are considered "sui generis", because of animals being living creatures, and able to feel pain and sadness, like man does. The proposal for a new Czech Civil Code contains a new definition of the concept of animals, labeling them "animals" rather than "things". In Italian legislation, animals are unfortunately also defined as being "things", but a current law proposal also suggests adopting the legal notion of "animals". On January 1st, 2010, the new Czech Penal Code (n. 40/2009) has come into effect. This Code has given the inspiration for an offence of animal mistreatment, and established, in §303, a new crime, that of animal mistreatment in cases of severe negligence.
