PROMĚNY ÚSTAVNÍHO PRÁVA V SOUVISLOSTI SE VSTUPEM ČR DO EU ABSTRAKT Vstup České republiky do Evropské unie se dá bezesporu považovat za jeden z nejdůležitějších milníků ve vývoji českého právního řádu. Méně či více významným změnám se nevyhnulo snad žádné právní odvětví, včetně práva ústavního. Množství literatury svědčí o tom, že jsou proměny ústavního práva mezi českou právnickou veřejností důležitým tématem, literatura v této oblasti je však poměrně roztříštěná a povětšinou zaměřená na určité dílčí problémy. Tato práce se proto pokouší shrnout některé důležité změny, které nastaly v oblasti ústavněprávní materie v souvislosti se vstupem do Evropské unie, s konkrétním zaměřením na oblast institucionální a otázky postavení členského státu (a jeho ústavních institucí) v rámci EU. Práce se sestává z úvodu, čtyř kapitol (které se poté dále dělí s ohledem na problematiku) a závěru. V úvodu je vymezena oblast konkrétního zaměření práce a jsou nastoleny základní otázky tématu. První kapitola stručně přibližuje historii vstupu České republiky do Evropské unie. Druhá kapitola analyzuje postavení členských států v rámci EU. Zabývá se mj. otázkou povahy Evropské unie, jakož i vztahem práva EU a členských států. Třetí kapitola podává výklad o přímých proměnách ústavního práva (tj. v psaných pramenech). Stěžejní roli... MODIFICATIONS OF CONSTITUTIONAL LAW IN RELATION TO THE ACCESSION OF THE CZECH REPUBLIC TO THE EUROPEAN UNION ABSTRACT The accession of the Czech Republic to the European Union was certainly one of the most important moments in the development of Czech legal order. The impact of this step may be seen in every branch of law - including constitutional law. The large number of publications on this issue indicates that the changes of constitutional law are an important issue in the Czech academic society. Yet, the literature is mostly fragmentary and mainly oriented at only some of the problems. This thesis tries to gather all the important changes in the branch of constitutional law, which occurred in relation to the Czech Republic's accession to EU. As the constitutional law is a very broad topic, the focus is laid on its institutional part and on the role of member states (and its institutions) within the EU. This thesis consists of an introduction, four chapters (which are further divided with respect to the single topics), and a final conclusion. In introduction, the focus of the thesis and basic questions are defined. Chapter One briefly follows the process of the Czech Republic's accession to the EU.
