Změna v subjektech právního vztahu nájmu bytu Nájemní smlouva, nájem bytu, nájemce, pronajímatel Abstrakt Cílem této práce je popsat právní poměry vzniklé změnou subjektů v nájemním vztazích. Hlavním důvodem pro volbu tohoto tématu je autorova osobní zkušenost s řešením problémů vzniklých v důsledku přechodu nájmu k nájemnímu bytu. Dále i zkušenosti získané během stáží na civilním úseku při Obvodním soudu pro Prahu 3 a také i skutečnost, že problematika spojená s nájmem bytů má velký význam v českém právním systému i z důvodu velkého počtu osob žijících v nájemních bytech. Práce se skládá z deseti kapitol, z nichž každá se věnuje různým aspektům. První kapitola poskytuje informace o historickém rámci pronájmu bytů. Zkoumá se zde vývoj úpravy ve srovnání s římským právem, po celý středověk až do dnešních českých právních předpisů, včetně aspektů nájemní smlouvy v období 1811 až 1918, včetně doby první republiky a po roce 1948 až 1989, tedy v období pod komunistickou vládou. Druhá kapitola se zabývá právními aspekty, jimiž se řídí vztahy mezi pronajímatelem a nájemcem. Především rozsahem občanského práva vztahujícím se na pronájem, nájemní vztah, práva a povinnosti zúčastněných stran, obsah a formu nájemního vztahu. Podnájem a skončení nájmu patří mezi další otázky. Třetí kapitola popisuje různé druhy... The substitution of parties to the legal relationship in relation to renting apartments The contract of rental, the renting apartments, the landlord, the tenant Executive Summary The aim of the thesis is to describe the legal relationship aspects arising in relation to the substitution of parties to renting apartments, with the focus being on substitution initiated by the tenant. The key reason for choosing this topic is the author's personal experience with dealing with the issues that arose as a result of the transfer of rights and obligations pertaining to renting of an apartment of the author's acquaintance, his experience gained during the assistance at the civil proceedings held by district court for Prague 3, the fact that renting is currently an issue of great significance in the Czech law system, and also the increasing number of people living in rented apartments. The thesis comprises ten chapters, each of them considering different aspects of the issues involved. Having provided the background information to the reader in the introductory chapter, the first chapter considers the historical framework of renting apartments.
