63 8. ZÁVĚR Finance veřejného sektoru vytvářejí předpoklad pro existenci a řádné působení veřejné správy při poskytování veřejných statků a služeb. Agenda, kterou jsou územní samosprávné celky zatíženy, ať už při výkonu působnosti samostatné nebo přenesené, vyžaduje neustálé finanční zdroje, ze kterých budou kryty veřejné statky a potřeby. Od vzniku samostatné ČR doznala právní úprava související s rozpočtovým právem veřejných rozpočtů podstatných změn v souvislosti s reformou veřejné správy v 90. letech minulého století. Byly tak položeny právní základy pro územní samosprávu vykonávanou na dvou úrovních, s čím již dříve počítala samotná Ústava. Právní úpravu místních rozpočtů vychází ze zákona o obcích, zákona o krajích, zákona o rozpočtových pravidlech, o rozpočtových pravidlech územních rozpočtů a celé řady dalších zákonů. Pokud v textu této práce zmiňuji územní rozpočty, mám především na mysli rozpočty obcí a krajů. Tyto rozpočty jsou ovšem pouhou podmnožinou rozpočtů místních, do kterých můžeme navíc zařadit rozpočty dobrovolných svazků obcí, Regionálních rad regionů soudržnosti a další. Státní rozpočet představuje finanční plán předpokládaných příjmů a výdajů státu. Jedná se o každoročně přijímaný právní předpis ve formě zákona. RESUMÉ Budgetary structure presents collection of the state budget, there are some links between them, although the concrete budgets are relatively independent. It is possible to observe their connections because there are some financial relations. On the local level we speak about a budget of municipalities and regions and then about budgets of subjects which develop on behalf of these regions. The state budget is constituted for the whole state, but there are some other budgets eg. budget of municipalities, budgets of voluntary bonds of municipalities etc. Budgetary structure consists of many different budgets, the most important role is playing the state budget. The state budget can be defined in many ways. A budget can be described as a financial plan, a balance sheet, monetary fund or a means of financial policy or means of government. There should be also defined its relation to budget of EU and to a budget of regions. The capital can be transfered among the budgets. If the subsidies are given by state to a local government, there are lots of tasks, which have to be fullfiled. The subsidies can represent an act of solidarity between the concrete budgets.
