[cze][eng] 66 7. Závěr Ve své práci jsem se snažila vystihnout veškeré povinnosti a omezení, které jsou vlastníku lesa, a to především soukromému vlastníku lesa, uloženy, ale zároveň i jeho práva. Omezení vlastnického práva k lesu jsou značná, což je ale nutné, aby byl les chráněn, neboť les je svým způsobem nenahraditelný, člověku poskytuje velmi mnoho, a proto je na místě poskytnout mu zvláštní právní ochranu, aby jeho vlastníci nezneužívali své postavení a dbali i na jiné, než jen své ekonomické zájmy. Vždyť i jim les přináší řadu výhod prostřednictvím svých funkcí, a to nejen funkci produkčních. Vlastníky lesů je tedy nutné korigovat při jejich hospodaření v lese, aby tuto činnost prováděli šetrně a řádně, a to s ohledem na zachování lesa. Souhlasím tedy s omezeními, které pro ně ze zákona vyplývají. Stát by ovšem mohl vlastníky lesa finančně více podporovat, aby byli přeci jen více motivováni ke správnému zacházení s lesy. Pokud jde o obecné užívání lesů, je poněkud na pováženou, aby to byl právě vlastník lesa, který je oprávněn udělovat výjimky ze zákazů týkajících se obecného užívání lesů. Pokud je jen na vůli vlastníka, komu a jakou výjimku udělí, a to jakoukoli formou, je poněkud nevyhovující. Může tohoto oprávnění využívat výlučně pro svůj finanční prospěch, což pro ochranu lesa jistě není dobré. Určitě by...70 Resumé a název práce v anglickém jazyce: Rights and duties of forest owner (Práva a povinnosti vlastníka lesa) The thesis is composed of seven chapters. Chapter one is introductory. Chapter two defines basic terminology used in the thesis. The legal regulation of rights and duties of forest owner is based on the Forest Act (N. 289/1995 Coll.). The forest is a forest stand with its environment and land determined to fulfil the function of forest. Other terms defines in this chapter are especially function of a forest, the land designated to fulfil the function of a forest, and the forest categories. Part two of this chapter is describing historical progress of forest ownership, what is ownership, who can be the forest owner. Chapter three is about basic rights and duties of forest owner, about the relevant Czech legislation, control of observation duties. Chapter four concentrates on rights and duties of forest owner within forest management. This chapter is subdivided into six parts. Part one describes the forest managing. Part two is about forest plans consisting of regional plans of forest development, forest management plans and forest management guidelines.
