Cilem me prace je ukazat postaveni a možnosti obce při ochraně životniho prostředi, ktere ji skyta aktualni pravni řad. Obec disponuje subjektivitou jak veřejnopravni, tak soukromopravni. Soukromopravni subjektivita se uplatňuje předevšim při spravě vlastniho majetku.106 Obec se často chova jako soukromopravni subjekt i při řešeni problemů ochrany životniho prostředi. Zakon o obcich stanovi povinnost obce chranit tež veřejny zajem.107 Je třeba položit si otazku, jak vnimaji a hodnoti veřejny zajem obecni zastupitelstva. Posuzovateli a kvalifikovanými prosazovateli těchto (veřejných) zájmů mohou být pouze orgány veřejné moci.108 Organem veřejne moci obec jistě je, ale fakt, že většina obci nema vice než 1000 obyvatel, vzbuzuje pochybnosti, zda takova obecni zastupitelstva reprezentujici zajem několika stovek občanů jsou organem dostatečně kompetentnim k nezávislému posouzeni veřejneho zajmu, ktery se může velice lišit od lokalniho zajmu občanů obce. Je třeba si ale uvědomit, že obec ma jine priority než je ochrana životniho prostředi a to zajmy socialni a ekonomicke. Proto je stat garantem ochrany životniho prostředi, jak vyplyva z ustanoveni Ustavy. Pravě při ochraně životniho prostředi je kontrola ze strany statu a podřizenost rozhodovacich složek důležitym regulatorem pravě z toho uhlu pohledu, že obec... The aim of this thesis is to analyse the position of the municipalities in the area of environmental protection, to refer to municipal problems in this sphere, which come up in current scope of duties and to present some of the instruments, the municipality can solve this kind of issues with. The thesis is composed of four chapters. Chapter one and two is introductory and defines fundamental terms in the thesis: The environment, the municipality. I try to find out, who is responsible for environmental protection, the relation between public and private interest in the environmental protection and which one of these interests is overriding. Next is the analysis of the position of the municipalities in it 's separate powers of community and in it 's delegated powers of community. I illustrate with giving some examples the fact that the municipality can be in various positions, as a one, who makes the rules, mainly during issuing ordinances or as an individual subject, first as a owner of the municipal property, second as a party to some administrative procedures related to environment, e. i. to apllication for a planning, EIA, IPPC… Chapter three is subdivided into three parts, each of them introduces the group of instruments of environmental protection, that the municipality dispose with.
