Tato disertační práce se zabývá zdaňováním stálých provozoven a vlivem pravidel transferových cen na způsob určení základu daně stálé provozovny. Nejdříve popisuje důvody vzniku stálé provozovny a zkoumá, jak mezinárodní i tuzemská legislativa přistupuje ke zdaňování zisků daňových nerezidentů. Práce dále analyzuje způsoby, jakými se určuje základ daně přiřaditelný stálé provozovně. Závěrečná část zkoumá, zdali lze z veřejně dostupných finančních údajů získat dostatečné informace pro stanovení základu daně stálé provozovny vzniklé z titulu závislého zástupce. K tomuto účelu je využita metoda regresní analýzy, shlukové analýzy a logistické regresní analýzy. This thesis deals with taxation of permanent establishments and effect of transfer pricing regulation on method of attribution taxable profit to permanent establishments. Firstly, the thesis describes reasons for creation of permanent establishments and analyses how international and local legislation approaches to taxation of their profits. It also examines methods of attribution taxable profit to permanent establishments. Finally, the thesis analyses whether it is possible to use publically available data for determining tax base of "dependent agent" permanent establishment. For this purposes the following methods were used: regression analysis, cluster analysis and logistic regression analysis.
